    Hi, Received reply back from THe Colt Car Company yesterday saying that I have to refer the claim to the business that sold the cover, which was the garage that I purchased the car from. How will they beable to deal with the claim as they were selling a Shogun/LTSB product ie financial PPI. Surely they will just have to refer back to either of those which is where I started in the first place. Also recieved a reply from MBNA with regards to mum OH Virgin CC in which they would not uphold his claim as he had ticked the box. Also stating that thye PPUI appeared on a seperate screen to the application and so it would have been clear that this was seperate to the credit card application. it also states that he stated that he was eligible as he was employed and aged between 18-70 and they did not offer advice. They also attached a copy of the financial information with the tick boxes. They have stated that this is their final response and that he can refer his complaint to FOS. What do you think? Can I go back to MBNA or should I go direct to FOS. Thanks in advance.

    This does not look like an "advised sale" to be honest, as it appears the loan was applied for on-line. MBNA are saying the person selected the option for ppi without any guidance from bank staff.

    Hi, yes I am afraid it does. The OH doesn't remember, the credit card was specifically applied for for 0% balance transfer so that it would give us more time to pay it all off in full. This was a short term solution which we paid up before the interest was due to be applied. Oh well you live and learn, write it off to experience. Thanks for your thoughts Moneyineptitude.:o:cry:

    This will get you the agreement, then you put the claim into Safestyle.

    Thanks for that but I've been in touch with Safestyle & they say we need to contact GE money for a copy of the agreement. Should GE still have a copy if the loan was taken out in 1998 & paid up in 2006? Thanks, Caz.

    Thank you all for the help earlier.
    Today I received an offer from RBOS for my PPI. But it says on the acceptance slip "I UNDERSTAND THE MONEY WILL BE CREDITED TO MY CARD BALANCE.IF MY CARD IS NO LONGER ACTIVE THE MONEY WILL BE PAID TO ME BY CHEQUE". I called them saying although my credit card was still I active I still wanted a cheque sent to me,not credited to my balance. I was told the amount I`m owed for my PPI would FIRST be ADDED to my credit card BALANCE and then deducted and sent to me in Cheque form. I find this very confusing. Why cant they just send me a Cheque?. Has anyone experienced this with RBOS and if so,is this how it worked with you?. I also may add I have no arrears and pay my monthly card on time as I always have done. I also called the Ombudsman and he was as confused as me as to the wording on the letter and to RBOS explanation about the not just sending me a cheque. They said they will contact them to get a cleearer picture from them on my behalf. Thanks

    As there are no outstanding arrears, you have nothing to fear. It should not matter that their method of generating the cheque involves adding it to your credit card first. Why the concern?
  • My concern was that the money I owe on my balance(approx half what i`m due for my PPI) would be deducted to clear off my credit card balance? .then send me a cheque for the remaining amount?

    Well, they can't do this without your permission unless you are in arrears with repayments.

    On the Halifax website, they've got a number to ring and you can put your complaint in that way.

    They do make it really easy, to give them credit where it's due!

    Thanks monstermuncher, think that I may have a claim. When I took out the loan I was made to feel that in order to get the loan that I needed to have the PPI. Also I work for an organisation that would have paid me full pay for 6 mths and then half pay after that for another 6 mths but was never asked about this!! Would this constitute a claim?

    Surprise, surprise. On receipt of my recorded delivery evidence, I got a phonecall on the same day saying that they uphold my complaint and an offer letter is on it's way for full amount plus interest. :j
