  • First time posting and unsure how this goes so please bear with me.

    Looking for some answers with regards to an unsuccessful Barclayloan PPI claim, Barclays wrote to me in February 2013, i responded and returned a claim for misold Insurance, they asked for extra info but as the claim was back in 2005 I had no paperwork, i just mentioned that i would not have asked for insurance at the time of taking out the loan as I never purchase anything other than basics. They have since told me over the phone that my claim has been rejected (still await actual letter, well overdue now). Can I now go to the ombudsman and do I have to request details of the loan to back up my claim as i said I have no original paperwork. Sorry for longwinded first post but would appreciate any assistance.

    thanks for the advice. I rang them & also queried why they charged £4.44 interest (current balances are on 0%). It turns out that was because they have transferred the money to my bank account!, needless to say that's been refunded! It was because part of the money registered as a purchase ????!!!!

    Did Barclays give you the account number when they sent you the first letter to make a reclaim? if they did then do a Sar request to Barclays, ask for all information they hold on you and this may throw the agreement up, it may not get any info due to the time lapse but you can try, this will cost you £10 and give them 40 days to respond.

    In the meantime, get in touch with Barclays and tell them you do not accept the rejection of your claim and that you have requested a Sar and could they wait until you receive the Sar, if the Sar throws up any more information, then you would like this to be looked at, if they say no then get the Sar info and put the complaint into the FOS.

    At this stage it is easier to wait with the Sar as it is a very long wait with FOS.

    Have Barclays said why they rejected this other than no more info from you?.
  • I have never bothered with all this PPI claiming lark, thinking I've never had any products with it on.

    This morning though I received a letter from Lloyds about my Annual PPI Review on a credit card I've had for years. I can't remember receiving a letter last year or any year come to think of it.

    I also can't remember if I'd have asked for it when I first received my card and have no paperwork from back then.

    My questions are, can you claim PPI charges from credit cards? If so which template letter would I use? I can't remember when I signed up for my card and have no original paperwork, would that be a problem?

    Apparently my cost of PPI in the past year was £39 and the monthly cost of PPI for every £100 of monthly benefit is £15.80?

    Are they sending this out now to cover themselves?

    Any help would be most appreciated.

    Thanks for your reply, Barclays did not quote an account number on the original letter would the SAR cover everything on file?

    As to the reason behind the rejection I still await the Final response letter which they said had been posted to me on the 6th April, I have called them four times and they said another copy would be posted, 3rd May they sent a copy but it has still not arrived!:mad:

    I will await this correspondence and then call them to say I will be requesting details via a SAR and hopefully I can go from there.

    Hello everyone,
    I applied via the RBS telephone service for a PPI reclaim on a credit card I have had since 1987 on the grounds that I was told it was compulsory to have PPI and also that I was freelance at the time, therefore self-employed.
    I have received ( bang on the 8 week deadline) a response from RBS saying that they have refused my application on the grounds that they can find no evidence to support my claim.
    They say that they have no evidence of my employment status at that time, that it was standard practice to "not advise" the customer to take the insurance and to let them make their own mind up and that they have reviewed the 'sales documentation in my file'. They enclosed two arbitrary photocopies of credit card statements - one from 2001 and one from 2013 as 'evidence' of their investigation. They also claimed to have tried to contact me repeatedly by phone although nothing was left on my answerphone and I received no calls on my mobile.

    I appreciate from reading here that the next stage would be to go to the Ombudsman, although I am concerned that it might take up to two years.

    I think I can refute the claims that they have made directly by :
    A - I opened a business account at the same branch 1 month before applying for the credit card, operating as a Freelance Photographer/assistant. I have the bank statements and my accounts from 1987.
    B - They claim to have the sales documentation but I was advised by the manager of the PPI reclaim call centre that took my initial claim enquiry that they did not keep any records before 1995. I had asked if I could have a copy of the original documentation for myself ( paying the £10 fee ). So they appear to be lying.

    They have already stitched me up once recently as they 'lost' my letter cancelling the PPI that I sent to them the day I made the claim. I had to do it again by telephone when I discovered they were still taking the premium this month.

    The question is (finally)- Should I confront them directly with the evidence quoted above and give them the opportunity to make an offer, and how long does that take? Are they obliged to operate within a timeframe like the original 8 weeks? Or should I proceed to the Ombudsman knowing it could take up to 2 years?

    Sorry for the drawn out post but I thought it would be best to give you all the information.

    Any advice would be genuinely welcomed.

    I know its been a while, but I have more info on my dilema.

    I noticed the date of the offer was the same date my claim was withdrawn.

    I then phoned RBS and asked how this may have happened. Theylooked into it and I was informed that it was a clerical error on their behalf. I asked them to provide me with a letter explaining what has transpired. They did this and the letter clearly states that it was a error and no offer was made until Feb 2013 as the case was withdrawn.

    I then sent this to HYC however they are insisting onpayment or applying for a CCJ against me. They have also asked me to sign another letter of authority to be put back on the case. Im not sure if that’s wise ornot. They claim they would like to ask the bank questions and nothing more butI don’t know what the legal implications mean towards my claim.

    I have kept all correspondence from emails between myselfand HYC. I have asked them on many occasions why the proof I have provided is not sufficient and I still have not been given a answer.

    Should I sign theletter of authority ?
    Is the contract I signed valid if there is no declaration signed

    What are the terms of cancellation for the contract?

    Photocopy the letter from RBS and send it to them, and explain that you owe them nothing as they had stopped working for you by then.

  • Does anyone have any advice? I have received an "annual statement" from NatWest on my Mortgage, this is the first time I have had anything like this and have noticed that I am paying for PPI insurance that I do not need.

    With the information sent to me there is a questionnaire that I filled out when taking out the mortgage, which asks how I will make payments if unable to work etc.. In plain handwriting I have written " 6 months full pay then reduced pay thereafter" under this there is an option to take out PPI which I ticked to say I do not need.

    Looking at the statement it looks like I have been paying PPI @ £18 per month since 2005

    Do you think there I have a case here? What is the best way forward? Phone or writing ect..?

    Anyone had the same issue? Any advice would be great.

    If Barclays identified you as you may have been Mis sold PPI initially, if you do not get the info you need as you do not have the account number, then contact them and ask how they knew you had a loan with PPI and requested you complete a form, where did they get this info from and could you have a copy.
