    I recently tried to claim PPI which i am 99% certain I had on car finance some years ago. (The car was £5000 and i paid back £10800). I remember buying the car which was from a dealership some 40 miles away from where I live. I was told this was the only finance deal they could do as i had not had any previous credit history (I did have a mortgage at the time!!) Anyway I was not very savvy to finance and just wanted a new car:j

    The salesman actually brought the car to my house with his pal and i signed for it in my own lounge! Guess they were keen uh?
    With advice from MSE I wrote to Santander (who had taken over from GE Finance) and they couldn't do anything without ref no. So I got this and they still couldn't proceed. FOS said i need to get in touch with dealer which I did and was asked to write to Pendragon which i did. Pendragon said, some weeks later, that they cannot proceed because it was 'time barred' and 'before 2006'.
    Can anyone offer me advice please? I read on MSE possibly take them to court?? How? Small claims perhaps? And will i need a ppi company to help or could i do it alone?

    The answer is the same as for your duplicate posts;
    If you bought this before January 2005 your complaint will be dismissed because the car dealer wasn't regulated.
    FOS often advise approaching the underwriter but, as they didn't sell it, it isn't their responsibility.
    You won't have much luck taking them to court because PPI selling is not a legal issue . You can't use a claims management company because you have already complained and you can only complain once. A CMC would have done no more than you have anyway.
    If you went to court it would likely be very costly with no reward.

    Hi, I took out HP with Car Giant in 2004 and closed it in 2006. I was charged PPI as a monthly premium as I was a temp at the time and I was told that I would most likely not be able to secure finance without being a permanent employee. I informed him that I had enough money coming in to pay the monthly installments even without working but he insisted and I took out the PPI and got the car. I never missed a repayment and in fact closed the loan early as i moved abroad. I wrote to the FOS regarding this and they put me onto Welcome finance who provided me with the finance. After a long winded process they responded that Cargiant were the brokers and so I needed to deal with them. Welcome finance forwarded my details to Cargiant along with my claim letter. I simultaneously sent my letter and documents across on 25.02.2013. I received a letter acknowledging receipt of my documents on 01.03.2013. I was told they would respond within 8 weeks. I sent them an e-mail on 04.05.2013 asking for an update. the Compliance manager was very sarcastic and in effect said he'd never heard of me. When i responded back saying that it was funny as he had signed my acknowledgement letter, he replied asking for my details again. Yesterday I recieved a mail saying they see no evidence of PPI being mis-sold. Now i know this is not the case and how can i go about it further?

    You can't. They weren't regulated then.

    Does this now mean that any money paid out by me is lost even though i have documents stating that i paid PPI and I also was a temporary worker at the time. I understand it's my word against theirs, but surely that doesn't mean it's null and void.

    Yes, your complaint is against a car dealer which wasn't regulated at the time you purchased the PPI. As a result, Car Giant didn't have to consider any complaint you made and you now have no access to the Financial Ombudsman Service either.
    If you do contact FOS, they will suggest that you might want to pursue the insurer who provided (not sold) your PPI, but your chances of success with that are minimal.
  • I logged my claim for credit cards with Halifax for a Halifax and Sainsburys Bank card, and great news my complaint has been upheld. However:
    Saturday 4th May - Confirmation letter received (dated 29th April)
    Thursday 2nd May - Cheque issued (received on Tuesday 7th May)

    They ask me to contact them asap if I don't want to accept their offer, but they have paid me (although i've not cashed the cheque) before I have even had chance to read through the documentation.

    Is this normal?? It sounds very dodgy that they are paying me this quickly - any help appreciated
