Barclacard held since April 1998. I haven't got any statements. Went to ombudsman and Barclays said it will payout. They offered me a goodwill gesture of £2000..which I'm not happy with. I don't think it reflects 14 years of paying ppi on a card I continuously used. I've just called them and they said a letter has been sent out this week to say they are sticking to their offer!!! Just to add also last year they refused my Subject Access Request and sent my cheque back to me!
I'm unsure about what to do next! Considering they don't keep statements past 6 years!! Where did they get my figures from then??

Hi, sorry not to back read through the thread if this has been already asked.
My husband received his payout from LLoyds Bank but his offer letter was not received just his cheque which we felt was good so didn't query it because the time limit was over.
I also claimed but my letter of refusal was not delivered either and it took months before I found out and too late to appeal it with the bank, how fortunate for them (Lloyds TSB)
I appealed to the Ombudsman who ruled in my favour and said Lloyds had to respond by March 8th. Nearly two months later after a query to the Ombudsman who said they hadn't heard from them, what can I do next?
Anyone know what the likely waiting time is after a ruling by the Ombudsman before the payment is made?

Barclaycard DO keep statements beyond 6 years. I've got statements from them from 1998, and they're still looking back further. This was under a SAR.
Why did they refuse your Subject Access Request? This is your right under the Data Protection Act. They may not have been able to identify you or needed further information but they can't outright refuse you. I'd be tempted to try the SAR again but bear in mind the letter from Barclaycard (if full and final) starts a 6 month clock for you to get your complaint into the FOS.
It's possible that if Barclaycard have broken the DPA then you might be able to complain to the Information Commissioner about the SAR but this can take months to resolve.Competition wins:

The FOS will deal with this, there is nothing you can do so you will have to wait, don't expect a quick fix though as this could take a long time, it may not but if you think the worse case scenario and you get it sooner then this is a bonus.0 -

They are not obliged to keep any records longer than necessary, and if they returned your subject access requst and cheque then they are saying that they no longer hold any records about you.
If you think they do and are prevaricating, get in touch with the ICO and make a complaint to them, They will force Barclays to comply with your SAR.Non me fac calcitrare tuum culi0 -

I'm in a similar position to posting by Anna75.
You kindly advised me to send SAR letter (posting 6467).
Yorkshire Bank sent my SAR letter and cheque back as well quoting
"We must advise that due to the passage of time since closure, we regret we are unable to supply any previous documentation as paper work has been destroyed in accordance with the fifth data protection principle.
We do not retain documentation relating to these accounts once we have gone past the retention period for the product they relate to."
You say in previous posting to get in touch with the ICO, forgive my ignorance but what does ICO stand for?
Should I call Yorkshire Bank bluff (I know I had at least 3 personal loans with them all with PPI attached) and make a complaint to the FSO

The ICO is http://ico.org.uk/ Information Commisioners Office.
You can't call their bluff, they are saying they have destroyed their records, which they are advised to do by the Data Protection Act.
Without your own paperwork now, your complaints are over.

Thanks guys..I'm just dubious about the fact they don't send me my SAR as requested for with cheque payment and I'm sent a 'gesture of good will' for an amount that I really don't believe covers 1998-2013 PPI payments on a 'busy' haha Barclaycard. I'm in touch with directors office and a lovely lady who is head of customer relations is putting priorities on my case. I'm starting to get so frustrated as I'm so close to receiving payment. :0
