Thanks for your reply think you may of mis understood what I meant. I never used my SSP, I've always paid & could repay my card. I've just rang them back to get a run down, basically just cause she thinks Halifax wouldn't of mis sold it my case have been rejected. So it is all in her opinion, you think I should take it further or a waste of time? She said it could take another 2-3 years. I'm disgusted!
It doesn't matter that you never used it. They think that you didn't have the means to pay off your card if you were to become sick.
You haven't given them proof or evidence in your complaint that you could have paid this debt with savings or some other form of income, so as far as they are concerned, it wasn't missold because you would have needed it.Non me fac calcitrare tuum culi0 -

You can complain over the phone or in writing. You shouldn't have been paying it if you were a student and working les that 16 hrs a week.

No, I explained I worked for a family business & would of always been able to make repayments & told h&m I could prove this.0

Working for a family business means nothing at all, it just means you're related to someone you work with. It doens't mean you can rely on the money coming into the business to get you out of financial hardship.
I don't make the rules on miselling.
You had to show either you didn't need it, or it wouldn't have paid out if you did need it. You havent done either of those, hence your complaint has been rejected.Non me fac calcitrare tuum culi0 -

We are struggling with a claim with the Halifax. Slightly different in that we asked for PPI on our mortgage and were well aware of what is was for. We asked at the time of purchase 'how long before the policy kicks in in the case of sickness/redundancy?'. We were told 30 days. A few years later my husband was made redundant. We tried to claim after the 30 days and were refused. The reason given was that my husband had 12 months notice period from work. I complained two or three times that we had been told 30 days - no mention of any waiting for notice period. The Halifax said they had not mentioned it as it was very unusual for anyone to have a 12 month notice period. We paid our insurance so I don't really see what difference the notice period from work made anyway. I have asked several times since and once in the last month - 'just out of interest if I take PPI on my mortgage how long does it take to kick in?' Same answer - 30 days!. I remember being furious at the time but then leaving it. Now after all the press and advertising I decided to give it another go. My husband was made redundant in 2003. We have had a letter from the Halifax saying they won't pay out because we were made aware in the documents we were given what the terms and conditions were. I don't think its reasonable to give wrong verbal answers (either lies or just unknowdgeable staff) and expect us to read the fineprint and check it against their answers. Hope this makes sense, I have appealed and am waiting for another reply.
30 days after the 12 months notice, then the claim could have been made.
If the claim for redundancy in 03 was put in after the notice period plus 30 days then they should have paid up, if the claim was before this but it was not explained to you that you should put the claim in after the notice period, then keep at them as you should have been told this.0 -
Claimed PPI back from Santander on Flexiplan loan that was originally taken out in 1990 with Girobank which became Alliance and Leicester which was then taken over by Santander. Santander have agreed to pay back PPI with interest (result!) but only back to 1997 because they say there records don't go back any further. They say if I've got bank statements going back to 1990 they will reconsider, obviously I don't - is my only option to accept their offer?0

Yes. Without proof you paid it, there won't be anymore but, If it was part of the same loan, they should be able to extrapolate back how much was owed if they are upholding your complaint.Non me fac calcitrare tuum culi0
