    Did you complain to Sainsburys about your PPI? Sainsburys are Bank of Scotland, not Halifax.

    Thanks for reply Taff, im not mistaken I have evidence in black & white from RBS stating MPPI on credit card but found no evidence of miss-sell.

    You are quite right my complaint to FOS is against RBS but when FOS write back they say RBS (Trading as Halifax) which was were the Halifax comment came about.

    I was a shocked as anyone when I read that letter from RBS.

    We are struggling with a claim with the Halifax. Slightly different in that we asked for PPI on our mortgage and were well aware of what is was for. We asked at the time of purchase 'how long before the policy kicks in in the case of sickness/redundancy?'. We were told 30 days. A few years later my husband was made redundant. We tried to claim after the 30 days and were refused. The reason given was that my husband had 12 months notice period from work. I complained two or three times that we had been told 30 days - no mention of any waiting for notice period. The Halifax said they had not mentioned it as it was very unusual for anyone to have a 12 month notice period. We paid our insurance so I don't really see what difference the notice period from work made anyway. I have asked several times since and once in the last month - 'just out of interest if I take PPI on my mortgage how long does it take to kick in?' Same answer - 30 days!. I remember being furious at the time but then leaving it. Now after all the press and advertising I decided to give it another go. My husband was made redundant in 2003. We have had a letter from the Halifax saying they won't pay out because we were made aware in the documents we were given what the terms and conditions were. I don't think its reasonable to give wrong verbal answers (either lies or just unknowdgeable staff) and expect us to read the fineprint and check it against their answers. Hope this makes sense, I have appealed and am waiting for another reply.

    Hi

    In 2004 i took a loan out with Egg and PPI was added at £1600, i then extended the loan in Oct 2004 and signed a new credit agreement, with PPI added at £2500. I have already claimed the PPI back from the second loan and won.

    However i just realised that the PPI from the first loan may be applicable for claiming back. Do you think if they were seperate agreement numbers i might have an argument to reclaim from the first loan or do you think the PPI from the first loan may have been incorporated into teh second loans PPI or do you think they may have ripped me off and just taken the £1600 PPI from the first loan although i technically only had that loan for 4 months?

    I don't know if that even makes sense but what do you think?

  • Hi, made a claim to ombudsmen for credit card had ppi on with Halifax last April. Got a call today to say hat it had been rejected as I had statuory sick pay where I worked. I'm confused! Halifax told me I wasn't likely to get card unless I took out ppi.

    The lady said I can take it to ombudsmen if I want but I thought they were the ombudsmen, I have waited a year for this answer! Any help would be appreciated, thanks

    The BOS loans could have been consolidated and would have been Single Premium PPI, you could use this as a reason for mis sell, this PPI was in fact a loan on the loan that you repaid to term with interest, each loan that you did after this one that repaid the original loan would have got you a rebate of the PPI, the remaining PPI would have been paid back by you in the settlement from the next loan, in effect, you are paying interest and PPI from the previous loan....and so on.....

    St Andrews Group wrote to me on the 5th March with that Questionnaire I mentioned. I have not yet replied to it, considering my options and seeing if my SAR came back promptly. They have also now written to me on the 12th (just arrived today) saying that they reject my reasons stating that the PPI was not compulsory and that the brochure they sent to me AFTER I'd agreed to it on the phone spelt that out - regardless of the fact I was told on the phone that I wouldn't qualify for the loan without taking the PPI alongside.

    My original phone call was 2 February, they send me a questionnaire 5 March and write a week later saying "we have not received the questionnaire back yet so we find no reason for misselling?" Are they trying to force me down the ombudsman route? Or hoping that I'll be easily dissuaded?

    They also mention that prior to 2005 (this loan was dated 2002) PPI was not regulated by the FSA. Although they mention the GISC and their standards.

    IS this really a lost cause? Bear in mind that I have no original paperwork... (although the SAR may rectify that it is not guaranteed since the loans go back to circa 2000-2002). They say I should call them if i disagree with their assessment (which I clearly do) or write to them "providing further supporting evidence" - of which I have none except my testimony.

    What should I do?

    They rejected it because SSP isn't enough to live on let alone pay back any monthly debt.
    Your case went to an adjudicator, not an actual ombudsman.If the FOS were like your workplace, your case has been handled by a manager, one step down from the ultimate boss, the site manager, who makes a decision based on the info they have.
    An ombusdsman is the ulitmate level or the big boss.

    Based on what you've said, it's a bit pointless taking it further unless you can prove you had a separate income that could pay back any monthly debt or savings to cover it.

  • Hi guys! Two weeks ago I've received a letter from my bank (Halifax)-titled 'Annual review of optional ppi on your credit card'. Basically it gives an info about how much this insurance has cost me in the past year. Till that letter I had no idea of having this insurance! I called Halifax today to check how long I had ppi for and their reply was since March 2003. Following money saving expert advice I've requested the copy of my agreement which they were happy to send. Did any of you dealt with Halifax and got some of your money back? Should I wait first for the copy of it and then complain over the phone? What's the best thing to say?
    They also said I got ppi the same day as I applied for my credit card, I don't remember anyone mentioning it to me at the day or explaining anything to me, I didn't know I had it untill now. I found some statements from 2005-2007 but when I checked there was nothing on it stating that I have been paying for it.
    At the time of getting my credit card I was full time student and could work only 16 hrs a week. Does it matter at all? Thank you all for your time and help.
  • Thanks for your reply think you may of mis understood what I meant. I never used my SSP, I've always paid & could repay my card. I've just rang them back to get a run down, basically just cause she thinks Halifax wouldn't of mis sold it my case have been rejected. So it is all in her opinion, you think I should take it further or a waste of time? She said it could take another 2-3 years. I'm disgusted!
