PPI Reclaiming Discussion Part 5

I think MBNA must be snowed under right now .... sent 3 complaints off ( 1 loan and 2 credit cards ) in Jan .... Got acknowledgment of all 3 very quickly . About 2 weeks ago 1 of the cards complaint was rejected .. now in the last 2 days I have had letters to say that the other 2 complaints are taking them longer to investigate so it will be another 4 weeks.
I know lots of people are unhappy about the time taken to respond but have to say that I have been kept updated what is happening at each stage ( even if I do not agree with the result of my first complaint )0 -

Yes, the same for me as well. Always regularly updated.0 -
Hi All
I'm not sure how to search for details on this so i thought i'd just ask in a post. I've complained to my lender about the PPI being missold and their "Final Response" was that they disagreed and i could now complain to the FOS within the next 8 months bla bla. They also enclosed a few sheets of reasons why they came to their decision. My question is, Is it worth writing back to lender again saying i'm not happy with the decision and that they have '(timelimit)' to offer me something better before i go to the FOS? OR is it now time to get my complaint into the FOS?
Thanks

Was this a Credit card or loan, what were the reasons for the rejection?.
As this is a final response, you should now send this to FOS, depending on the reasons you have for mis sale, will depend on what you need to say to FOS to strengthen your case.0 -

Thanks for the Reply.
It was against a mortgage i took out with a local Building Society. I thought the next stage would be the FOS but i just thought i'd ask if the lender is effectively closing the door on it in terms of them dealing with me any further.
If I send a complaint into the FOS i'd like to send a cover letter explaining things that can't be said in the questionnaire, you know my personal version of events for instance. Does anyone know if there are template letters for this? I know the details maybe different but how the letter is laid out might be useful to me.
Thanks

You can use the template letter for mis sell of PPI and send this to FOS and enclose a covering letter with any additional info that you need to.
As this is a final response the Building society may not respond to you, you could try though and if they do not respond, or give you the same answer after you have given them reasons why you think the claim should be upheld then send it to FOS, you only need to send a letter to the Building society with the additional info and ask them to look at this again for you.
What were the reasons they gave for not upholding?.0 -
I had a vague recollection of being pressured to take out PPI when I took out a loan with Lloyds TSB. But I couldn't be sure, and I couldn't even remember how many loans I'd taken out with them.
About two months ago i called their dedicated PPI line. I told them I believed I had been missold PPI as I felt pressure to do so. I got a letter informing me they were looking into it, and this morning received a letter saying following their investigations they were refunding me £1,290 for three loans I'd taken out.
I'd put off doing this thinking I was ineligible and only did so after a work colleague had been successful. I can't recommend it to others enough - you really have nothing to lose.0 -
Some MPPI is not reclaimable, I am not " in the know" regarding this type of PPI, what type of insurance was this? if you post the details dunstonh or magpiecottage may see this and guide you.

The reasons for them rejecting it were basically that i'd been shown all the forms (which they enclosed) showing where the boxes had been ticked (apparently by me) and signatures were scribed. They also went into detail about my wages at the time and how much i would have to pay if i didn't get that income however they didn't know if i had any other money anywhere from other sources so i thought this was a bit presumptuous of them. They went on to explain what the benefits would be if this and that happened and as you read on it appeared to steer away from the actual point of accepting or rejecting the PPI. Although the PPI was organised some 15 years ago (I was 20years old), and details are lost to my memory, i do know that i was naive and this was my first venture into borrowing. Also the woman dealing with it was known to my partners family and so with that in mind I know I would have already been agreeing with whatever she said. It was also an endowment mortgage aswell which was under her instruction but thats another story.
PS the PPi was through General Accident0 -

Do as I suggested in my last post to you, send all the info you can to back up your claim that you could have paid this Mortgage back.
I hope dunstonh or magpiecottage look at your post and guide you better, as I said before, some MPPI is not reclaimable.
Start a new thread http://forums.moneysavingexpert.com/forumdisplay.php?f=187 Title it MPPI rejection, give as much detail as you can as to what the Insurance covered and hopefully those familiar with MPPI will let you know what your next step must be.0
