PPI Reclaiming Discussion Part 5

I was contacted in 2011 by CMC about reclaiming PPI, the claim against Barclaycard was sent to FO as Barclaycard denied mis selling.
I decided to ring FO yesterday as 2 yrs had passed & nothing. FO said that they believed I had been mis sold & had notified CMC in Nov 2012, I rang them, & was told Barclaycard now has the chance to find more evidence to show it wasnt mis sold, where would they get this if all original paperwork was assessed by FO, surely they wont have any further evidence to back the claim up, if so why wasnt this used initially.
Im confused.
barclaycard said same with mine, needed more time to get "proof" together. 5 weeks later sent fos so called "proof".
my contract which was so poor quality fos went in my favour for the second time.
just another way of trying to proloooooooooooong it even further as to not pay out.
next step is for them to either make offer,or go to ombudsman and fight it.
see where it goes. good luck with your claims. dont give up.0 -
Hi just looking for advice from anyone been in similar situation. Tried to claim PPI back from HFC after taking out a loan through Beneficial Finance in 2004. Loan was paid off in 2007 & the back account I had at the time is now closed. I have all original paperwork which has been copied & forwarded to HFC twice who insisted on back statements also. BOS advise that account has been closed for such a number of years they cannot provide any bank statements to me. HFC also say they no longer have records regarding the loan so have turned me down. Will need to go to FOS now but just find it frustrating!! Original paperwork doesn't seem to be enough for them!0

girlfriend had similar loan form benefical finance that you had, as benefical no longer running,it was passed over to some company sorting out benefical claims on the behalf of hfc.
she had original paperwork, sent "a copy" of original paperwork to them, they worked out the amount owed back from ppi ,and within 4 months, paid out.
cant see why yours is any different,as they can use info off your own original paperwork.
sorry cant remember who company was,but if you google it,i'm sure it will pop up, or just ask hfc who is working on there behalf.
hope some of this helps. dont give up, thats what they want you to do.0 -

Because they want to see that you paid all the PPI, and didn't pay the loan off early.Non me fac calcitrare tuum culi0 -
CAN ANYONE HELP? i paid ppi on a car finance loan that i had which ended 2 years ago. the bank i was paying it to are saying that i have to make a claim from the car garage that sold me the loan as that is where the mis-sale took place but the garage has now closed down! what can i do as i am trying to claim this myself instead of paying for a company to do it0

If you were sold ther PPI prior to January 2005, and the car dealership that sold you it has closed, your complaint is over.
If it was sold after January 2005 you may be able to use the FSCS to claim your PPI back.
A company can do no more than you have already done.Non me fac calcitrare tuum culi0 -
Hi all
this is my first ever post on here. I'm guessing that some of what I may ask has been covered here but there is so much information I'm not sure where to start, forgive me for repetition or redirect if I'm in the wrong place.
I would like to investigate the likelihood of a successful PPI reclaim from Midland Bank for a loan for a car purchase. I do not have the original paperwork and at this stage am vague about the date of the loan. I do know it was for around £3500 and back in 91 or 92.
I'm hoping I can get more about dates and other information from a credit history company eg Equifax or other. In addition I have contacted HSBC by telephone who (fobbed me off) told me that they don't have any info or records further back than 6 years ago.
To proceed I'm going to contact credit check companies then send an SAR.
I know I was mis-sold PPI as I was very naive and just did what they told me so that I could get the loan, nothing was explained to me and no alternative was given.
What do you all reckon the success likelihood is without any paperwork and it being so long ago?0 -

Even if your credit check turns up an account number, it won't show PPI amounts paid I'm afraid. Expect HSBC to demand documentary proof of PPI payments and so , without these, your complaint fails before it begins.
You can gamble £10 on a SAR letter but, as HSBC have already told you they no longer have records from more than twenty years ago, it's very likely a waste of money.
