It's not an appeal, it's the original complaint. You can now eihter go to the FOS and wait up to 18 months, or wait a bit longer to see if LLoyds come back with anything.

You have 6 months from complaining or from the full and final letter to go to the FOS.

Seems like Lloyds is treating it as an appeal, which means the usual eight weeks don't apply. I think this justifies another complaint to be honest. Since the Bank rejected on the basis that they had no record of the account, being sent proof of same should mean they reconsider within the eight week timescale.

Lloyds hae doen the smae with me but it is 19 weeks since I wrote. I did write again explaining that they hadn't sent out an acknowledgement of my letter asking them to look aty my complaint again.

I got a letter back this time because I had said that witjhout it I would need to appeal to the FOS. It has said that they have a backlog and will look at it as soon as possible before sending out a final response so I am just now waiting and hoping that as the costs for them from the fos is going up they will look favourably on it as it was missold to me. Fingers crossed.

The consumer questionnaire asks for both a policy number for the ppi and also an account number for the loan.

I have my First National credit agreement which lists Ocean as the broker. This states the loan amount, the additional payment protection premium and the subsequent total loan facility (loan+ppi). Then it listed my monthly repayment.

My first question is this; is that whats referred to as front loaded PPI?

A couple of weeks after this First National then sent me confirmation of the loan along with the account number. At the same time they also sent me through the details of the PPI, at which point I found out it actually only covered me for 5 years as opposed to the full term of the loan. Yet surely the interest from the added PPI would of carried on being repaid througout the remainder of the loan term after the PPI had lapsed after 5 years?

But there is no separate account number listed for the PPI.

Ocean also sent me a letter to confirm the loan had been finalised which had their reference number on it, however in the absence of a separate PPI policy number will just the loan account number suffice along with copies of the paperwork that I have?
  • Hi everyone

I'm in a strange position. I made a couple of phone calls a few weeks ago to see if I could claim back PPI I was missold years ago ( I mean around 15 years ago) for which I do not have the original documentation. I contacted Lloyds TSB in regards to a credit card PPI set up in the 90's, and BOS regarding a number of loans taken out around 1996-2003. Both phone calls yielded results - ie they could find me on their system and begin the formal complaint procedure.

Now, I definitely paid for PPI on the BOS loans (except the last of those taken out) and on the Lloyds TSB credit card (but around 2003-2004 I cancelled the PPI on the credit card after a memorably heated conversation with the bank on the phone). But what I don't have in my hand is proof. I have received notice from both companies that my complaint is proceeding, and indications that they have uncovered other loan accounts / credit card numbers to investigate besides those which I have provided them with.

After a more thorough reading and understanding of the articles on this website I have now sent SARs in to both companies requesting all of the information they hold on me.

BOS have just now sent me a questionnaire to fill out and return to help them understand the precise nature of my complaint. (This is in effect a template very similar to the FSA questionnaire referred to on this site). The questionnaire asks for information which I cannot recall or be certain of: Like, did you repay the borrowings early and if so, how? I cannot be sure - I repaid at least one of the loans early (the final loan with BOS which had no PPI on it) but cannot be certain of the others. There are other questions I cannot answer too, like employee benefits - other than SSP I can't be certain what my contract of employment stated back then.

My question is this: Should I return the BOS questionnaire (or more likely the FSA version recommended on this site) now with my limited responses in order to expedite the process, or should I wait until I receive the SAR response and hope that that fills in some of the blanks? My original phone call to BOS was 5 February but the letter from them enclosing the questionnaire was sent 5 March 2013.

I wouldn't want to be impatient and harm my chances of obtaining a refund for PPI that was most certainly missold.

    Thanks

  • Hi taff

I read a post recently (can't find it now) where you stated Lloyds only sold single- premium PPI with loans taken before 2009.

    How do you know this?
  • Hello! Around 12 years ago I took out mortgage ppi. I work for the NHS as a Registered Nurse, full time. Did I need ppi? If I become sick or experience critical illness etc.. I get full pay for 6 months and after that time my sick pay goes to half pay for a further 6 months. Would it be worth me considering making a claim??

    Any advice would be appreciated.
