My retired elderly frail neighbours were well and truly taken to the cleaners by Lloyds re ppi l presented a claim for them using Martin's templates, we were rejected point blank in no uncertain terms by Lloyds, using Martin's templates again we contacted the Financial Ombudsman who actually phoned me up, within 2 weeks my neighbours received a cheque for £5.800 and the loan was scrubbed. Lloyds well and truly had their knuckles rapped.
All done using Martins brilliant advise and his templates, l wouldnt have had a clue without it, WELL DONE MARTIN and thank you so much for your advise,it works. Regards R French

Do as I suggested in my last post to you, send all the info you can to back up your claim that you could have paid this Mortgage back.

I hope dunstonh or magpiecottage look at your post and guide you better, as I said before, some MPPI is not reclaimable.

After re reading my reply from the lender, which is stated as being a last response, it also says i can reply to discuss and mattesr or if there are any new points i would like them to consider. So as i have a bit of time before i need to contact the FOS i have drawn up a letter to send back to the lender explaining why i disagree with there response. I have started by explaining we could all save a bit of time and effort here and commented where i deemed necessary and have finished off by giving a 14 day reply time limit. Nothing lost is there?

Worth a try, good luck and let me know how you get on.
  • I contacted claimandcollect because I had an old loan which I had paid off but no longer had the paperwork and policy number.

they said they would be able to process my complaint.

after a few weeks they called and said I needed to contact the bank and get a policy number!

i contact the loan provider, sainsburys, who denied I had taken a loan out with them let alone PPI.

i had to order and old bank statement at a cost and sent it to sainsburys.

during this time the CMC hounded me asking me for the policy number and signature which I didn't have.

after many many months sainsburys have admitted I had taken out a loan.

a few days later the claimandcollect sent me a threatening and aggressive letter demanding £200 plus vat payment because I signed for them to investigate even though they said they couldn't without the policy number!

i am disgusted as they told me to contact the bank on their behalf which I did and now they are demanding a fee.
i have no intention of paying them and I had complained. I advise anyone to stay well away from this corrupt company I feel very very foolish for contacting such an organisation.

interesting enough my loan provider has no record of the cmc contacting them!..

Yes, and as I said before.....

I would pay it if I were you otherwise they will issue proceedings against you.
All claims companies do is make you do the work, then send it off with a stamp, or not even that in your case.
You signed a contract with them and now you will have to pay if you don't want to be in court about it.

If you have any more complaints, it may be worth cancelling the contract for which they can charge a 'reasonable' fee, because there is usually a clause saying that they will represent you in any future complaints.

It's too late to be "disgusted" and refusing to pay them will simply mean they will set debt collectors after you and/or take you to court.
Simply pay up and learn by your mistake.
  • Quick question regarding PPI:

If you have a PPI on a credit card account, and 5 months later after commencement you reach retirement age, does the PPI become null and void?

You would have to look at the terms of the Insurance to find out, I would have thought that the unemployment part of the insurance would be void as would the sickness part.

    ok thanks.
my mother had BOS credit card, and 5 months before retiring, had PPI applied to the account. She reached retirement age in 1998, but the PPI monthly payments ran until around 2003.
BOS reckon they have no case to answer, PPI was sold correctly, even though they knew she was 60 a few months after policy started.
I thought PPI became null and void once you hit retirement age? Just wondered if it was worth taking matter further? FOS perhaps?

It was up to her to cancel it, not the cmpany who sold it o her, but she could ask for her premiums back as they didn't cover her.
It was her circumstances at the time of sale that were important. not her circumstances after.
