After Creation Finance refusing my original claim for the ppi on my USC store card i wrote to them again asking to reconsider because I noted from the very bad copy of the agreement they sent me it wasn't my hand writing that the form was completed in even more reason to support my claim...

Can anyone help? I purchased a Car in 1998 from Black Horse, paid every month for the car! Got made Redundant have all the proof, Black Horse (Farnham Road) chased me for the payments I explained I had PPI, wrote to the PPI company the never responded to calls, emails or letters! I ended up going to court in 2005 and the manager of black horse said the PPI had changed since i took mine out. The judge awarded my car VW Convertiable to Black horse despite the fact I had paid more than 75% off of the car!! The judge advised I counter claim the PPI company..... I bought the car from Black Horse after the court case (I have the reciept) I was just so mad i realised I had PPI (Despite not realising I had taken it out) I was made redundant why didnt Black Horse PPI pay out? The Judge awarded the car to Black Horse on the advice I counter claim the PPI Insurance? I paid what was owed to Black Horse and kept my car?
Do I have a claim?

Hi I am waiting on capital one , had a loan with first plus did not know the ppi was with capital one until I contacted first plus , capital one refused my claim which I took to FOS , this will be 2 years in August and I am still waiting . Also have ppi credit card claim with capital one and they have done everything but pay me out they keep asking for more information :-(
What year was the first plus loan with Cap one and what reasons have you used for mis sell?.0 -

If you know who the insurer was, try putting a claim into them, you may not get far but you won't know until you try, as you were made redundant this should have made the PPI kick in, use this as a reason for mis sell as had you known you had PPI you would have made the claim, Black horse should have advised you of this.0 -
I'm one of the poor saps who got taken in by Lifestyle. A few weeks ago we had a letter from Synergy Financial Solutions telling us that our claim had been referred to them by Lifestyle Claims. Does anyone know about Synergy? Instinct tells me they're another bunch of grifters but I'd be interested to know how they got hold of name address and Bank reference.0

MBNA - I have put this up on another thread but this seems the right one. I had an MBNA credit card from January 1998. I got into financial trouble in 2005 and the debt was sold onto Link Financial. I have a copy of my original Application form where I specifically ticked the 'no' to say that I didn't want Payment Protection Cover (as MBNA called it). I have written to them with some evidence that I had various life insurance and critical illness policies, savings plans and shareholdings in excess of 130,000 plus 8 years of service at the company I worked for (so could expect at least the legal minimum redundancy payment). I alerted them to all these policies because they say they could not make a decision based purely on saying 'no' on my application.
My thinking here is that this cannot be a 'non-advised' sale because I said 'no' to it on the application form. And, if this was an 'advised' sale it was appalling advice because I had plenty of policies, savings and so on. My question is, is there anything else I can be doing here to strengthen my claim? I had thought that a copy of the original application form would suffice, but as a couple of the experts on this site have suggested when I posted this originally, they said that MBNA might say it was done on the phone.0 -
My daughter received a letter from "STUDIO", its like a catalogue company and a division of Express Gifts Limited, on saturday relating "to previous sale of your Payment Protection Plus policy".
It states
"As part of your STUDIO account you have the benefit of our PPP Policy. This Policy includes features that are known as payment protection insurance".
It goes on to say that they have
"recently reviewed their sales processes for PPP. It has come to our attention that you may belong to a group of our customers whose policies may have been affected by a common failing in our sales practices. The specific sales failing we have identified is that we may have failed to record sufficient information about you and your circumstances at the time the policy was sold to you and, therefore, your eligibility to claim under the policy. As a result of this, there is a risk that PPP may have been mis-sold to you. Whilst we have not individually reviewed the circumstances relating to the specific sale of your PPP policy, it may be that you have suffered financial loss as a result of this common failing and so you may be entitled to redress. For example, you may have made premium payments for a policy under which you or your partner (if applicable) would not have been eligible to claim.
Depending on your particular circumstances, there may be other reasons why the policy might have been mis-sold to you and where you could have incurred a financial loss. As a result of this, you may like us to review the sale of your policy, if so contact (it gives a number) where one of our trained agents will be able to establish your own personal circumstances and undertake a full review on your behalf. Please note there is a three year time limit from the date of this letter in which you may make a complaint to us and to the Financial Ombudsman Service."

Means exactly wehat it says.
They are writing to people to alert them that they may have been missold PPI, and to start the ball rolling on being able ot timebar future complaints.
