    Hi,

    First post & many thanks to everyone who contributes on this forum as it gave me the much needed advice & impetus to pursue my own claims.

    1) I recieved the same response from Cap1 as below:

    They're offering to pay me the offer directly however it appears that since I have an active account the money will automatically go to pay off the debt on the credit card?
  • Hi all, hopefully someone can help me out a little here? This morning I received a letter from Halifax bank saying they will compensate me for mis sold PPI on a loan I took out with them, the thing is I actually had 3 loans but they wont consider the other 2. All 3 loans had PPI included in the repayments, the first for £1000.00 I wasn't even aware I had PPI, the 2nd and 3rd, for £5000 and £10000 I was informed on applying that I stood a better chance of being "accepted" if I took the insurance? I don't understand why they can only compensate 1 out of the 3 loans? Would this be because the compensation would be considerably higher than the first? This doesn't seem fair to me! Any suggestions? Thanks :question:

    Have they said they won't consider the other loans and if they did what reasons did they give, or is it that you have heard nothing about the other two yet?

    Do you have the paperwork for these loans and what reasons did you give for mis sell?.

    If the PPI was " allegedly" taken over the phone, get back in touch and ask for a copy of the recording to prove this.
    I did notice in the T&C's for the account from when it was opened that PPI was integral & not a separate/ optional product as it now appears - does this make any difference?
    As this started as integral, get back in touch and tell them you were not aware you had PPI until it started showing on the statements as a
    separate item, also, why would you not take this when you thought you did not have it, to then take it after a phone call, ask them to provide the recording so that you know what was said by the salesperson to make you take this.

    If they have all the statements to show the PPI you paid they will give you full redress, if they have no proof then they will go back 6 years and redress accordingly.
    If the card has no arrears then they should give you the full redress, if there are arrears, they can take the redress off the card balance, if they pay the redress to you, this will go onto the card and they will raise a cheque and then take it off.

    i've been checking my dad's other accounts and it appears that he has ppi on two credit cards that were sold on to other lenders at least twice . My dad can't remember how the ppi got put on on the original accounts but thinks that they used phone calls to sell it to him.

    is it a good idea to use a s.a.r. on the current owners to try and find out whether or not the ppi was mis-sold?

    my dad also had ppi on two credit cards that have now been closed. can we s.a.r. be used on closed accounts?

    You can use a Sar if you have no card numbers, but give as much info to help them trace your Dad. depending on the years these were taken out, it is possible they no longer have details of these if they were from a long time ago, if there were 2 cards with the same company, ask them to check other cards that were taken with them.

    Any cards that you have the card numbers for and reasons for mis sell then put claims in, get your dad to look here for reasons mis sell.

    Some of the reasons may have applied to your Dad, was he retired, had good salary and sick pay, life insurance, could he have repaid the card should the worst happen ? he needs to let them know that he had no use of this insurance.
  • Hi, I took out a mortgage and was told I had to have the life insurance through the mortgage company also or else I wouldn't qualify for the mortgage. Is this the same thing as misold PPI does anyone know? Do I have a case as it was over 10 years ago.

    Not the same thing. It's only missold if you didn't plan on dying at all, or if you had no dependants or were single.
