PPI Reclaiming Discussion Part 5

Hello, just a quick message if someone wouldn't mind helping...
I took a credit card out in 2007 with then Lloyds. I can't remember how I applied for it so can't recall if they 'missold' me PPI. However the first time I became aware of it was at Christmas when they sent me an annual review - I have been paying over £200 a year.
I called LloydsTSB's PPI complaint hotline and after some interrogation the letter confirming my complaint states simply that
"In your telephone call you told me that you didn't know that you have PPI"
Is this complaint sufficient in the first instance? It is the truth but I can't remember if I was hassled into it or even given an 'opt out' box to tick.
They are processing my claim now but if you think this is not sufficient perhaps I should change my complaint to something stronger?
Many Thanks for anyone's help.:)0 -

Probably not
If you can't remember, and you tell them something they can prove is not true, your complaint will be rejected anyway.
To say you didn't know you had it is a weak one because it's written on every statement if you pay it.Non me fac calcitrare tuum culi0 -

You can expect a rejection letter stating that you were provided with thorough documentation at the outset of the policy and were given a thirty day "cooling off" period in which to cancel. In addition, you will have received a monthly statement (so around 60 of them:eek:) detailing exactly how they extracted this £200 a year you have been (unknowingly?) paying.reclaiming2013 wrote: »I can't remember how I applied for it so can't recall if they 'missold' me PPI.
It is not wrong to have a PPI policy, nor is it somehow the bank's fault that you failed to check your statements for over five years. The PPI was not randomly added without your knowledge; it is far more likely that you've simply forgotten giving your consent to it.

The Op is reliant upon the Bank finding some other failure during their investigation or on the amount being complained about being beneath the floor limit for auto payout.0 -
Hi,
Can anyone please advice with what my next step is with Lloyds TSB.
I have written to Lloyds three times and each time have included copies of statements that date back to 2001 in which it clear shows that I did have PPI. All three times Lloyds have sent a standard letter that states, "We have searched our records extensively and can not see that you ever took out PPI".
I have orginal statements going back to 2001 which clearly shows that I did have PPI and have already submitted these to Lloyds but they are still refusing on the basis that they have no record.
Do I have to take this to the FOS or can I esclate within Lloyds as it crazy that I am sending in original statements and yet they are still saying they have no record.
Any help welcomed.0 -
FOS but make absolutely sure it is PPI.Non me fac calcitrare tuum culi0

Are you absolutely certain that the statements show PPI and not some other insurance?
Banks typically keep records for around six years and it's obvious that your "evidence" is not sufficient to sway their opinion that you never took PPI.
All I can suggest is that you write a Subject Access Request (SAR) letter which should provide everything the Bank has kept on file for you for at least the last six years and (sometimes) more.
Other than that, you could ask the Bank to explain exactly what the statements you have actually refer to.
If you refer your complaint to FOS then be aware that you only have six months from the date of the original rejection in which to do so.0 -

Hi the statements are orginials and show the date and credit card number. Also it shows what was labelled "Credit Card Protection Plan" for which on average I was charged about £8.5 - 10.50 a month.

As they've rejected you three times, I think you may need to refer this to FOS. As I said, you only have six months from the date of the first rejection to complain to the Ombudsman...0
