  • Apologies if this has been discussed elsewhere but I wondered if anyone else had had trouble with Santander not even acknowledging initial information requests?

    I had a Cahoot loan with them between 2005 and 2010 and have no idea if I had PPI or not. I can't find out as all statements were online and my account is now closed so I can't access my details.

    I emailed their PPI email address and when I heard nothing after a month sent a letter. Another month has passed and I haven't had my request acknowledged at all - and all I want is a copy of my original agreement.
    Does anyone know where I can go from here?

    YES!! No response either!!! Barclays too!!! Seems to Me any of them who think You may have a claim ignore You!!

    Since the original agreement is not available to customers whose accounts are closed/loan paid off, the lack of action is not surprising .
    Whether they respond is not dependent upon the likelihood of your complaint being upheld.
    You are both simply low priority because you've made a request for information no longer available to you.

    If you want to find out old account details you both need to send a Subject Access Request (SAR) letter which costs £10.
    The provider has forty days to respond with all information it has on record going back at least six years and (sometimes) more.

  • Just received the final decision from the FOS and they have not upheld my complaint against HSBC for the mis-sell of credit card PPI - Completely gutted! Is there anything else that I can do now?

    My complaint has been with the FOS for over 3 years. I was deliberately mis-sold PPI for a credit card they gave me in 2004 that I didn't even want or need at the time. I was at the bank to discuss another matter when they asked if I wanted a credit card as if it was a regularity of being an HSBC customer. When I accepted they failed to mention anything about optional PPI to me. I was told I just needed to sign a form in order to complete it. Even the signed form that they have produced in evidence mentions nothing about the PPI being optional. Being young and naive and not having had a credit card before I mistook PPI for interest.

    At the time I was in full time employment, had sick pay, a large sum of money in the event of my death, was living at home with little outgoings, had some savings, was in good health etc etc so had no need for PPI - The FOS still sided with HSBC despite them being found guilty of mis-selling PPI on a monumental scale. I really don't understand how they can come to this conclusion.

    According to the FOS I would have been sent documentation to read about PPI. Surely if this is the case most people would have received this documentation that I allegedly did?! I would be very interested to hear how people who have successfully claimed money back have managed to prove that they didn't receive this.

    My case was seen by an adjudicator in 2009 (pre-banks losing court case) who did not uphold my claim. Apparently a second adjudicator (post court case) did uphold my claim after 2 years of waiting but the Ombudsman didn't go with that decision to uphold my complaint and rejected it. I need to write back and either accept of reject their decision which I will obviously reject.

    My question is: Is there now anywhere for me to go with this as I am obviously very disappointed with the final decision? Can I go to the Ombudsman review team or anything else?!

    You've exhausted all your options, the Ombudsman is the final arbiter. Time to move on I think.
  • I have tried to find the answers to these but this thread is massive so does anybody know the answers to the following:-

    When I met hubby in 93 he had a few loans that him and his ex-partner had defaulted on. We made 'arrangements to pay' and eventually cleared them over about 3-4 years.

    If we have reason to believe the PPI was mis-sold can we still claim even though the loans were defaulted?

  • Yes, you can claim but if you receive anything the money may be used to service the debts that were defaulted. Depends on the exact status of the debts etc.

    Thanks. When I was following up on what the monthly payment was I received the paperwork from St Andrews and it definitely was a Sainsbury's Bank Bill Protector payment.

    Someone else I ran this by said they thought it may more fall into a case of fraud as Sainsbury's should have informed St Andrews that payment should be stopped as the loan had been cleared.

    If it was a "bill protector" payment, this does not seem to be PPI , if it was PPI it would show on the loan agreement as PPI insurance, give St Andrews a call and ask what this insurance actually covered, this is the only way that you will find out for sure, maybe Sainsburys can help with this and tell you what it was for.
