  • i have received my t&c from Barclaycard(originally egg ) but they cant find my agreement letter , do I now send a cheque for £10 asking for more details of my account , and do I do this on all accounts of should I just phone them asking if I had ppi

    Why do you want it? It isnt needed for you to make your complaint. It won't aid you in your complaint.

    If you do a DSAR then it wont be specific to an account. It will be everything they can find.

  • I have always been employed, which was always put on my application for loans or credit cards, but have also run a successful business. Was always told to put my employment down but my question is if I became out of work with the employed job would they have paid me out because they would have wanted details of my income and that would have brought the self employed income into the equation, thoughts please

    Received a letter today from Cap1, reads-

    I acknowledge receipt of your authorisation form enabling us to request information from Future Mortgages.

    I'm currently obtaining all documentation and relevant information from the lender in relation to this sale. Once we have received this information we will be able to investigate your concerns and will be in a position to provide our final response.

    If we have not completed our investigation into your complaint within the next 8 weeks we will write to you with an update on any progress that may have been made.

    Head of Executive Response Centre

    Ok a few points
    1. This is already with FOS
    2. The 8 week response time has expired on 03/12/12
    3. What information will they need from Future Mortgages, if Capital One were the "seller" of the PPI??
    Can anyone provide me with any advice as to what to do next? Do I write to Cap1 and ask the questions or do I allow the FOS to continue with their investigation? I really am at my wits end with it all now almost 19 months down the line I'm demented, just when I thought there was light at the end of the tunnel, I'm ready to give up the fight!!

    Leave it with Capital one as they are waiting now for info from FM regarding your claim from FM, as they are in the process of this then the 8 weeks start again,they may deal with this before the 8 weeks, you never know.
    If Cap one find you were mis sold then they will redress, or not as the case may be, either way they will give you a decision, as this is with FOS they may deal through them or contact you direct, just let this take its course.
    No point giving up now you have gone this far.

    I've read the FAQ's on this but I was recently
    approached by a claims company saying that despite I am over
    6 months to take my complaint to the ombudsman they can still complain for me as it would be deemed a new complaint? Is this correct? Will this start process again and give me another chance? If so whats to stop me putting in a new complaint my self? Dont really want to use complaint compant.

    I was rejected in 2010 Oct but, and know this is silly had a wedding to organise which tookup all of my time!

    complain again yourself, the ruling hapened 2011. They can only reject....

    Its a half truth but mostly a lie. You have 6 months to refer to the FOS. If you dont and have no good reason for the delay then your complain cannot be viewed by the FOS and any further complaint made on the same thing can be refused and referred back to the original decision. However, if the complaint was made some years ago (I forgotten the year but it was before the high court ruling) then the firm should review the complaint again upon your request. If it is more recent than that then its game over. As yours was 2010, you can ask the bank to review the complaint.
