    hey all xx
    newish to this so hopeing for some help
    just started ppi claims at wk end as i wasnt sure i could do them as joint loans wiv ex hub whos now dead.
    i have 3 with lloyds + my cc
    then 3 loans wiv welcome
    anyway rang welcome yest and so far so good nice man on fone gave me loan account numbs plus how much ppi i paid as i cleared 1 loan with another.so these are the numbs he gave me
    loan 1 ppi paid £392.94 taken out oct 03
    loan 2 ppi paid £892.51 taken out feb 04
    loan 3 ppi paid 373.57 taken out oct 04
    grand total 1659.02(omg)
    now they are sending me the questionaire to fill in this wk and need a little help working the figures out ive guessed from reading on here i need to add interest n stuff so any1 any ideas what i sould be adding and what the figures should be??
    any help would be fab and gets a big fat kiss sent via comp:D

    after just speaking to welcome again i have just been told my ex hub was the main erson on loan 2 allthough it as in joint names i wont be able to claim for it as we where devorced and hed re married before his death.they did say i would need a letter of probate to claim which i dont have.but after reading up online it says not needed if claim is £5000
    if i can prove we was married at the time of loan could i still try n claim? are welcome trying to fob me off? as all lloyds said was prove you where married at time of loan

    You will need to send a copy of the marriage and death certificate to them, they may still not accept these as you were divorced at the time you are claiming compensation.

    Whoever was the executor of his estate can make a claim for this but any award goes to his family, try the certificates and if that fails I would let it lie.

    Anyone making a claim for compensation for someone who is deceased has to prove they have the authority to do this, otherwise you could make the claim.

    The bank the credit is with can tell you if you have a claim, get her to call them.
    All you need are the account numbers ( the bank may provide these ), card numbers for CCs and reasons for mis sell, if PPI is on any of these then make the claims, if you use a company they get you to do all the " leg work " and they sit back and take a nice fat fee plus Vat, they do not find agreements Etc for you.

    PPI on a card will show as some form of insurance each month on your statement, if there is no other payment other than the usual, then you had no PPI.

    lloyds branch gave me a list when i went in it was just the loans numbs which i guess was all lloyds needed as i got 2 letters bk 1 for a cc that sed after looking at your cc we have found u had no ppi on(but i did have cardholder protection incurance on??) the other letter for the 3 loans said sorry for your complaint we will investergate give us 8 wks blah blah blah. im taking that as a yes there was ppi on the loans. now as i dont have the paperwork they where joint loans so does any1 know if the ppi would be joint too or just in 1 name?? cos i would of thought if it was just in ex hubs name the letter would of said yes there was ppi but not in your name so tuff.

    If they were joint loans, the main wage earner is usually the first named borrower, they are covered for the full monty, the second borrower is only covered for life.

    It is as simple as that, if you have reasons for mis sell then make the claim.

    Hi we need some advice,my wife recieved a letter from lloyds today after 13 weeks saying she was being offered £5,450 for her PPI claim,so we were overjoyed.She rang lloyds and they told her that the payment will be made to the insolvency practioner as records show she is linked to them.My wife was in an IVA over 3 years ago and came out of it and a full and final settlement was made to the creditors,so there is no link anymore.However lloyds are saying the payment will go to them and we will have to take it up with them???Help please!!!I forgot to mention that the Iva my wife was in was with her ex partner,thats why she came out of it,does that matter?

    Write back to them with the reasons you think you were mis sold and you reject the reasons they used for not upholding, see what they come back with.

    I've had an offer from HSBC regarding PPI on a loan. In their offer letter it says "This figure will effectively return the protection premiums you have paid along with an element of gross interest." But it's about £2000 short of what I paid, so what should I do now? Should I just write back and say it's not enough, or should I go to the Ombudsman? Confused.

    Is the loan still running or as it settled early? you only get PPI back that you actually paid less any rebate for early settlement or if the loan is still running.

    Many phone calls later with no result, Egg simply stated that the claim was rejected and therefore closed and could not be re opened.

    I need to add that for a further 2 months following my redundancy, I continued to pay my PPI pemiums.

    I didn't hear anything more from Egg, then in August 2006 I was contacted by CapQuest Investment Managemet claiming that they had been assigned my debt and were chasing me for payment. I explaind both by telephone and in writing that I did not agree that any such debt existed with their company and that the matter should be dealt with by Egg.

    I called Egg to ask them what was happening and they refused to speak to me. Several calls back to them resulted in Egg terminating the call as soon as I had given them my information. This was both rude and unprofessional but the biggest shock was still to come. I received upwards of 20 calls a day from CapQuest threatening me with legal action, Bailiffs visiting my home, CountyCourt Judgements and telling me that my family was at risk if I didn't pay them. Needless to say, I started to (and still do) screen all incoming telephone calls.
    I received several letters containing veilled threats then silence, nothing at all for a further 2 years.
    In 2008 I was again contacted by Capquest using one of their many and varied trading names. This time, having searched the internet for information and advice I sent them a letter stating that the alleged debt was statute barred because no contact with the original creditir had been received within the past six years.
    Again, they went silent until another year later when they again wrote to me threatening legal action but the debt had jumped from the original £2500 to a whopping £8500!
    I wrote back explaining that they could not legally apply interest to the alleged debt as it was in dispute (information from the local CAB) and that there was no contract of any form between myself and their company which there wasn't. I have never acknowledged this alleged debt with CapQuest nor have I made any agreement with them regarding the matter.
    Again 12 months of silence and another letter drops through the door. I again sent them a copy of the statute barred letter and added the OFT Debt Collection Guidance statement "continuing to press for payment after a debtor has stated they will not be paying a debt because it is statute barred could amount to harassment under section 40 (1) of the Administration of Justice Act 1970"

    On January 4th 2012 I received notice that Capquest started County Court Judgement procedings against me (posted on Christmas eve 2011 by second class mail to ensure it wouldn't reach me for days).
    I responed to the claim using the courts service online claims system disputing the claim and filing what I thought was my defence which clearly outlined everything above.

    Apparently I did not submit the correct form for defence and a judgement was made against me automatically in March 2012.
    I immediately responed by submitting an application to have the judgement set aside and the hearing moved to my local court.
    I then received a notification from HM Land Registry that CapQuest have placed a charging order against my property!
    This is before any hearing has been heard and I took it as a further example of CapQuests bullying tactics.
    The application was duly processed by the court and a hearing arranged in Chambers which didn't go well for either side.

    The judge had been informed that this was an uncontested claim and had only allocated 5 minutes for the hearing.
    She became extremely irate when it became apparent that this was not the case and adjourned the hearing until October 1st 2012 when a further 30 minutes has been allocated.

    I desperately need some assistance to get this matter sorted out successfully as I am currently unemployed so cannot afford legal represenatation and I am also trying to set up my own business and a CCJ against me will prevent me from being a Director of my own business. The charging order on my property will also reflect badly and cause problems whenattempting to source finance to get the buiness up and running.

    This is all having a detrimental affect on my health and I am not sure how much more of this I can take.
    I don't have anyone I can go to for help or even just to vent to so I really am stuck.

    Can anyone please offer a ray of hope or at least point me in the right direction.
