    1. Wrote to Clydesdale on 11th November 2011 requested copy of agreement related to loan. Received response dated 16th November that stated CB records confirmed that loan is now repaid and therefore under no obligation to provide agreement.

    4. Received response to my complaint on 12th January 2012 stating that they have been unable to determine whether PPI was sold in connection with the loan in question. Complaint closed.
    5. I wrote to Clydesdale 23rd February in the form of a data subject access request. Received response dated 27th February, containing all my current account transactions from Jun 2001 to account closure in October 2008.
    - This refutes point 3 above which stated that CB were unable to trace any accounts in my name.
    - It also refutes the claim in point 4 above that CB were unable to determine whether PPI was sold in connection with the loan in question. The statements clearly show that the loan was settled in June 2005, i.e. within the last 7 years and therefore CB are obliged to still hold these records (as I was informed by one of your PPI team members on the phone today, 9th March 2012).
    6. I wrote to Clydesdale 29th February requesting that the complaint be reopened due to further evidence and enclosed copies of the current account statements showing transactions relating to my loan (see attached pdf file) which show the following:
    - Loan received Jul 03
    - Repayments of £69.64 monthly until loan settled early. The settlement transaction clearly shows a PI insurance rebate on the same day.
    Interestingly, when I called today to enquire of the progress of the complaint, CB claim never to have received this letter and evidence.
    I will now resend this documentary evidence by special delivery to ensure that receipt will be recorded and that my complaint will be processed.
    Please be informed that I have retained copies of all the correspondence in question and will be forwarding it all to the Information Commissioners Office as evidence of obstruction of my right to access personal information.

    Hi, I've just seen your post. I am sorry to see you're having problems.

    There is one thing that has occurred to me, and apologies if this isn't the case, but do you have the right Clydesdale?

    We regularly get queries from customers of Clydesdale Financial Services, which is nothing to do with us, it is part of Barclays. It would certainly explain why we can't find anything.

    thanks and i think they did but im not 100% sure...should they have?

    When you cancel ppi the loan has to be redone without the ppi, i am sure that you would have noticed an increase or decrease in your payment?, they may just have cancelled the ppi and left it on your account!! you will get this back though.

    Hi, paying it all off would be a really great thing to do but not sure I would be able to.
    However I am waiting for a potential large inheritance pay out £25-£30k. What's the best to pay off, this secured 2nd charge on my property or all my unsecured loans, cards, store accounts?

    A bit off topic for ppi thread I know, sorry!

    No contest :p:p:p:p:p secured loan :D:D:D:D you will pay more interest on this type of loan than you will on any other debts, also you will have this secured loan payment free to take extra off the unsecured finances! make sure if you pay this off that the charge is taken off the property :D

    You could always chase up on the first one and ask where they are at with your complaint, tell them you've not received any confirmation from them about it being received.
    Maybe they will clarify this on the phone.

    In regards of the other, if this was a telephone sale, and even if you taken PPI, the guy also said without the ppi you may not get the loan, so you felt you had to say yes anyway.

    I think you stand a good chance, but keep us posted and we can take it from there.
    I would also ask for a copy of the recordings and have a listen for yourself, some will provide these free of charge.

    Thanks Di for your response. I have contacted Santander and they said that it was received on the 22nd February and is open to a case handler and being investigated but can take up to 8 weeks. They said they have posted me a few acknowledgement letters.

    Sorry Di, can I just ask if you feel that i stand a good chance because I had workplace benefits (the 6 months full & 6 months half pay plus redundancy package) would help strengthen my case? I have read the success and failures pages and it seems that some people win their case because of this and others do not but reading the FSA's "reasons for mis sell" it does say that if you were already covered and they did not ask the question to establish this, then that could be a reason for mis sold PPI.

    They should acknowledge within 2 weeks they then have 6 weeks from then to give you a final response.

    Personally yes I do, and because it also appears that you were not given the opportunity at the time to discuss this, and if you had known you could have informed the advisor your already protected.

    So yes you do stand a good chance going by the reasons you have.;)

    I feel completely overwhelmed despite the very useful info. I have my loan agreement and I have been paying PPI. Can I just write directly to my lender and enclose the questionnaire as in step 3?

    I would just continue to make the reclaim now with your reasons, as you already have the loan agreement.
    You send the reclaiming complaint questionnaire to the ones who set up and sold you the loan account.

    Make sure you keep copies in case you need to refer back to it at some point, good luck.

    Hi Amerasall not sure if the advice you are giving in your post #405 is to me .originally posted my query under #372 page 19 of this thread which Di has replied too ....can you offer any more advice ...how do I find the actual lender as have been going round in circles for almost 4years with this!

    Loan taken out with 1st national bank now GE FOS involved and said we needed the underwriter as GE not responsible but policy was from loan line who is now no longer trading ....as said to Di am ready for giving up as tried for sooooooo long
