    Hi Ammersall

I know you are very clued up re FirstPlus, :D don't know if you can remember, this was one of the 3 items I had sent to the [STRIKE]daylight robbery[/STRIKE] claims company before finding more paperwork & doing the rest myself.:money:.

I checked through the FP agreement last night, no signatures, just the actual customer copy & cannot see ppi on it anywhere, only interest & admin fee. You said you found it hard to believe there wouldn't be ppi on a FP loan.

    Original loan was 16.5000
    96 Repayments of £247.81
Interest from memory (posting from work) was 8.9%.

I am today sending off Argos details to FOS, don't hold out much hope but hey its worth a try.

Does not seem to be PPI on the FP one, this is strange :D the amount you borrowed over the term and the interest is correct for loan payment only.
If you had PPI then it would have been on the agreement.
Fingers crossed for the Argos one.

They also said that they sent me a copy of the Policy and I had a 30 day cooling off period so the onus was on me to cancel
They cannot use this as a reason for not upholding the claim, put this in your reply to FOS, also, show that you could pay this card back should the worst happen and why would you need PPI if you had no need of it.

I can see no explicit references to my having a PPI policy associated with the many credit cards and loans myself and my partner have had in the recent past. Does this mean that I cannot claim? Is it possible that the PPI is implied and not referenced in the paperwork?
If you don't have a Payment Protection Insurance policy, then
you can neither claim on it nor complain about it. Sorry.
  • Hello
I am in a bit of a confusing situation and wondered if anyone can help!
When I was resident in Ireland, I signed up for a Barclaycard at a shopping centre in Dublin. I was told the PPI was compulsory. Barclaycard in Ireland was taken over by Halifax. I moved to the UK. I continued to pay off this credit card until about two years ago when I got a loan to pay it off so, looking at some statements, it seems I paid a lot of money for something that I didn't think I had an option not to take.
Anyone have any experience of claiming back in this situation? And who would I approach? Halifax? Barclaycard? I'm thinking Halifax, but do I have a leg to stand on by going through the UK system or do I need to write to someone in Ireland?!
    Any help much appreciated!
    Louise
  • I've started pre-emptively filling out the questionnaire. I have my credit card statements and remember the situation under which (in my view) I was missold. Based on that, do I need to request any further documents?
Sorry if I'm repeating old questions...

A few years ago I managed to make a mess of my finances through regularly consolidating loans and credit cards I reached breaking point where my income could no longer cover my out goings. I got it all straightened out through CCCS (Consumer credit Counselling Services) and got my life back on track. I’m almost at the end of the DMP – I’ll have paid back every penny I owed (£40 grand worth of debt) by Sept 2013
Through the DMP I never had any of the debt I owed reduced – I have/will pay back everything I agreed at the start of each loan including PPI on all of them.
This is such a mine field I don’t know where to start and I’m generally someone who would not try, however I got a leaflet through with my monthly statement from CCCS suggesting I might be debt free sooner if a PPI claim is right for me, so thought what the heck – it would be good to be clear of the debt quicker.
    My creditors were/are:-
Barclaycard Visa – credit card – balance frozen – now cleared
Cahoot – online loan – now cleared
RBS – bank loan - still paying
IF – bank loan - still paying
I’m not sure I was actually missold the PPI on any of the above (I’d have to check the paperwork for the original agreements), but I wondered if by defaulting on my debts quite early into the agreements if I would be entitled to claim back the PPI as the balance was being managed through the DMP, I never claimed on the PPI and even if I lost my job, had an accident or became redundant whether I would have been able to claim on the PPI due to defaulting on the loan/credit card anyway?
If any more information is needed to answer my question I’m happy to provide it. Thanks in advance for any advice.

Non-taxpayers need to reclaim from HMRC any such monies paid by the Bank.

You can complain about mis-sold PPI, but any redress awarded would go towards your defaulted debt.
