With the MS card, Barclays are correct, you need to contact MS and see if they can find you, they are the ones you do the complaint to.
If an account is closed a bank does not have to supply you with a copy of the agreement, you will have to do a Sar request if you have no card numbers to make the complaint with.
With the Natwest Loans, do you have the account numbers? if you do then put the mis sell claim in.

Thanks for that, i have now sent away the SAR so hopefully I will be able to get some info back from that.
I have also checked my credit file and yes, it is still on it but it doesn't list any reference/agreement no???
I have received back a reply from Blackhorse re my SAR and they say without the agreement number thy cannot provide any information as their records do not go back that far.
Is that me now? I don't see any way forward from that though I know from my credit report that i paid roughly £4000 in ppi0 -
Thank you, i didn't realise all I needed was my account number which I got from a a photocopy of an old cheque i requested from the bank clearing the balance on the credit card. I had written it on the back obviously for reference at the time. This is because I knew roughly when I'd paid it off. Your advice also explains why MBNA went out of their way to only show the last four digits of the my account on their correspondance, thus stopping me from putting in a claim!!! Claim form printed and about to be completed. Thanks again

You paid this Loan off in 2007 there should be in the archives the info for this as it is only 5 years, unless they dispose of info before 5 years, did you use the last 4 digits on the credit report?.
Give ICO a call and ask if it is right that Blackhorse destroy data before 5 years.

Hi, thanks again for all your help so far. Three and a half weeks into the eight week timescale, fingers crossed for good news from HSBC.
In the meantime, I am trying to reclaim from MBNA for PPI on my ex's credit card. He has received a copy of his application for the card where he ticked for insurance. However, he is adamant that he was told he would not get the card without it and was never told he could shop around for more competitive cover.
A strange thing on the application is that they noted his income at the time, as well as household (our joint) incomes. Why would they have asked for this when I was never a joint holder on the account, never had a card, etc.?
Any clues on what should be our next steps would be very welcome. Do you think he has a chance. Once again, a million thanks.0 -

I would certainly give it a try.
When you say he ticked it, can he recall ticking this, or did they do this on his behalf?
Yes good question about joint income, this in my opinion as a separate card holder alone, should just be his own, I would definately raise this up with them for sure.
Write back and tell them you do not agree with the decision they made to reject the reclaim, as you have grounds to complain and would now like to add further information, then mention about the 2nd income that should have had nothing to do with a single card holder.
Keep at them, even if you received a final decision, if you provide further info, they may consider reviewing it and overturning it in your favour, ask them to let you know by 14 days, if you hear nothing, or if they still reject, then I would complaint to the FOS.

Hi there
If they were not regulated by the FSA etc, they tend to reject complaints, and the financial ombudsman service (FOS) are not able to take on a complaint if the business who sold you the finance were not regulated at the time you taken it out.
However, if you contact the FOS as a general query to explain this, they normally suggest writing to the underwriter/insurer of the policy instead as another avenue, as they may have been regulated at that time where NEXT was not.
If you pursue the underwriter/insurer and they reject your complaint, you can then try complaining to the FOS who will then investigate any relationship and liabilities the insurer/underwriter had in regards of the ppi being sold to you.
It may be worth a try.
If you do not know who the underwriter/insurer were, if you contact/write to NEXT, request they send you the policy details in the post, they should send these free of charge and it's what your entitled to on request.
Details of the above will be enclosed within the policy details document.

Hi thanks for this. They have not actually turned him down; just sent him a copy of the agreement, his up to date statement and t&cs. Don't know if this is their turn down, but they have made absolutely no reference to PPI in their cover letter.0
