PPI Reclaiming Discussion Part 5

Well, I phoned Barclaycard today as I had still not received an acknowledgement for my questionnaire received on the 4th April and the 8 weeks is just about due up. I spoke to my 5th helpline person and explained the problem and she said looked on the system, using all the information I had given the other people, and said that my acknowledgement letter was posted on the 5th April, gave me my reference number and said that I should either get a decision on the 1st June or a letter requesting more time!
Unbelievable! Why no-one else could have told me this, I don't know.
Still not received the acknowledgement letter so I phoned again today to be told that it had been sent out for a second time and it will now be sent out for a third time but by registered post. I just don't know what the problem is. I'm due to hear the decision on 1st June, god knows where that letter will end up.0 -
Hi everyone
I am all new to this so please forgive any silly questions...
I am keen to try and clam back PPI insurance, however apart from one card I don't think I have ever taken out PPI insurance on any of my other loans and credit cards. I have been looking through old posts for the last few days and have seen instances where people have been unaware they took out PPI so wonder if this could apply to me?
What is the best thing for me to do - call my credit card and loan providers and ask them if I have PPI on my current (and closed) debts, or send a request asking for my original credit agreement? I am worried about the second option as I saw someone's post which said the company they had asked to see their original credit agreement responded by closing their account - I couldn't afford to pay back my debts all in one go if that happened!!!!
I also have a mortgage with Northern Rock which was all done by a Financial Adviser so wonder if PPI was added to that? If I tried to claim from NR (and my other credit companies) could they end my agreement and make me go elsewhere/pay up in full?!?!
My main reason for trying to claim back PPI is to offset any amounts owe to me to my current debts/mortgage rather than having a lovley holiday etc. (which would be nice!!!).
Thanks in advance for any advice for this newbie...!0 -
scotland01 wrote: »Hi there – new to the site and finding all the information really informative!
I have been contemplating a PPI claim but not sure I have a case so was hoping someone could help.
I have had the same credit card for the last ten years (estimate – not really sure how long) – it was an RBS Advanta, then Mint and now back to RBS. If memory serves me right the PPI was sold over the phone. I only realised recently that I was still paying this from a paper statement (I normally just use online to pay) and I phoned and cancelled it within the last 6 months. The credit card is still active.
Thinking about this now, I never received a policy for this and I’ve worked in the public sector for the last 15 years, which means that I don’t think it would ever have paid out in the event of an illness as my sickness benefits are 6 months full pay and 6 months half. It also worked out far more expensive than what was explained to me.
Any advice much appreciated - thanks

If any/all apply to you, then put the claim in, use the reasons you gave above too, the account number is the card number.0 -

Call the banks first and see if they can find you, any they cannot find for you, you need to look at your credit file, this will show the last 4 digits of the account number, you can use these to send a Sar to each bank requesting all info they hold on you, enclose £10 for each bank, if you had Loans and CC with the same bank then you only need one Sar for that bank.
If you had PPI then it will show on the monthly statement for a CC, or on a Loan, it will show as insurance alongside the Loan figures.
CC accounts will have been closed or the credit limit drastically reduced due to the fact a copy of the credit agreement was requested, the banks may think that this is someone trying to get the debt made unenforceable, or the bank cannot find the agreement and stop the credit as the customer could use all the limit on the card and not repay this.
The Sar request is for all info they hold on you, do not ask for a specific item eg, statement, credit agreement etc as you want all info they hold on you, with a CC, PPI may not have been on the original application but added at a later date, so, a CC agreement may be of no use anyway.

Give them 40 days to respond.
With the Mortgage PPI you need to post the question here

I want to give you a couple of quote from them and ask for advice. The last sentence of the covering letter reads
Is this just Monuments way of putting people off making claims? Has anyone had any success with them?
Now here's the first part of the T&C that relates to the Payment Plan
So firstly does this mean it's not PPI?
Secondly, if it is, although it quite clearly says optional I can't see anywhere on the agreement where I was actually given the option. I'll admit I didn't read the T&C at the time of signing, I should have. But on the page where I signed there is no mention of The Plan, no tick box for me to opt in and no seperate box for me to sign for it. Essentially it was automatically included and I would have had to contact them to cancel, which I didn't because I was stupid enough to not realise I had a choice.
The insurance is not PPI, it is not classed as insurance and is not regulated according to the terms and conditions, I think you would have trouble claiming on this as it is a monthly payment and they could argue that you could have cancelled this at any time.
Having said that, put a claim in and see what they come back with and cancel this payment now and save yourself some cash.0 -
Because you requested the agreement they think you are going to get the debt unenforceable, they are telling you that it is.

DJKris2010 wrote: »I've sent my claim in and got my fingers crossed. I can definately see them making that arguement, however, my point here is that I didn't know it was optional therefore wouldn't cancel. I know I should have read my T&C properly, but I didn't and that's really my fault. I just didn't know until all this PPI stuff started getting coverage that I had an option.
They cannot reject your claim because they sent you the terms and conditions, the FOS do not accept that this gets them off the hook.
I hope you can get something back for this, but I would cancel this insurance now.0 -
Hi everyone,
I decided to bite the bullet a few weeks back and wrote to several companies that I had loans or credit cards with over the years. MBNA was one company I had my first ever credit card and I remember very clearly having ppi because it was costing more than the repayments on the card. I cancelled the card as a result. I requested account information using the template letter on this site. I received a reply stating that 'they could not comply with my request'. No explaination as to why! They cashed the cheque I had sent as payment and stated that 'they will not issue court proceedings' and that 'I am oblidged to keep up repayments as my debt continues to exist'.
They obviously made no attempt to actually look at the acount because I cleared the balance in 2006. I even went online requesting confirmation of my outstanding balance, worried I had overlooked a silly outstanding balance of a few pence. My balance was confirmed to be £0.
I promptly replied explaining that my request for information had no bearing on how much I owed or in my case did not owe the company. Secondly that I was at a loss to understand on what grounds they felt it necesary to issue court proceedings and thirdly they had accepted payment for information they have not supplied.
Eagerly awaiting their reply0
