  • Hi guys.

    I'm claiming on behalf of my Dad. He has had lots (too many) credit cards over the years, and has had to consolidate many times. He got into arrears with most of them and is now on various (fairly small) repayment plans.

    Looking at his documents, he has had PPI on a fair few of these:

    Alliance & Leicester (MBNA)
    Barclays (Loan)
    Capital One
    HFC
    Lloyds TSB

    And we are still waiting on s78 responses from several others. Plus we need to ring HSBC and Barclaycard to clarify whether he had PPI on those accounts too (it wasn't apparant from the documents provided as a s78 response).

    Anyway my question is as follows:

    Reading through the posts on here, it seems many people are far more in tune with why exactly they are claiming than we are.

    To be brutally honest, my dad can't remember one card from the next, so it is pretty hard to pin down our reasons for why we believe he was mis-sold.

    On some it is more obvious, ie. Alliance & Leicester's form states eg. 'We strongly recommend PPI'. But on most it is less clear.

    If we knew some grounds for mis-selling, we may be able to pick those that apply to my dad. So any advice as to what the accepted grounds are would be great. (I see many people talking of single premiums etc).

    FYI my dad was/is employed. He has no contractual sick pay, but there is an oral understanding with the employer that 3 months would be paid.

    Any tips/advice much appreciated.

    Having read all the great info on here and help received with my requests from Amersall I decided to phone one of my past lenders Black Horse about a settled loan I had with them. I had no paper work only my policy number. I asked straight out if my PPI was a single premium payment? The reply went like this - yes you did have a SP and we will send you out a claim form. End of conversation put the phone down on me or we got cut off (short and sweet). Q. Should I read into that brief statement that they will or may uphold my claim?. don't want to jump the gun and get too exited. Can it be so simple as just to make a phone call???

  • I am new to all this so i wondered if someone could help me. I am putting in a ppi claim for two of my existing credit cards, Santander and Tesco Bonus credit card but i cannot find the correct addresses to sent them to, any ideas?

    I'd read nothing into their statement other than what was said. Make a written complaint with valid reasons for mis-selling.

    As the account is closed, they are not obliged to send you a copy of the agreement, with CC the PPI may not be on the agreement but added at a later date.

    Because you have requested the agreement, they have sent a standard response as they think you are trying to get the debt made unenforceable, if you did have a balance they would have stopped your card so you could not run a debt up and then declare it unenforceable.
    All you need to make a claim is the card number and reasons for mis sell.

    If your Dad paid the Loans with one monthly payment that included the PPI then this is Single Premium PPI and this is the reason for mis sell that you use, this was a loan on the loan paid to term end with interest, if you cancelled the PPI they would have given you a pro rata rebate of the PPI and the remaining PPI is still on the loan to term end.
    If you settled this loan early then, as above you, would have a pro rata rebate and you would have paid back the remaining PPI in with the settlement figure.

    Look here for other reasons that may apply to the Credit Cards.

    Yes it can, do the form and send it back, do not forget that it is the Single Premium PPI reason that you use for mis sell and this is the most upheld of all PPI reclaims, do as dolphingazer advised and fill the form in now.

    Thank you, i didn't realise all I needed was my account number which I got from a a photocopy of an old cheque i requested from the bank clearing the balance on the credit card. I had written it on the back obviously for reference at the time. This is because I knew roughly when I'd paid it off. Your advice also explains why MBNA went out of their way to only show the last four digits of the my account on their correspondance, thus stopping me from putting in a claim!!! Claim form printed and about to be completed. Thanks again
