I am thinking of putting in a claim for PPI which I feel was missold to me, but I'm not sure if I can.
I originally taken out the loan in 2004, but I no longer have any paperwork, and the bank, HSBC has said it was unlikly they still had any records.
I do know I had PPI cover on the loan as when I went to the branch to sign the paperwork, I remember questioning why it was on the loan documents.
I was told that if I wanted it removed they may not agree the new terms and then they gave me the hard sell speel of not having enough funds to pay off the loan if something happened etc.
What they never metined was that I had a cooling off period and that I could of easily cancelled the PPI.
The reason I am wondering if I have ANY chance of getting anything back is that I did lose my job within weeks of the loan starting, and was told that I wasn't covered under the PPI due to the T&C's of excess periods etc.
I then fell so behind with the payments of the loan, the debt was sold by HSBC to a debt collection agency, and I am still paying this debt off!
I do have my original loan account number, thanks to the debt collection agency.
Is it worth trying to make a claim after all these years for something I didn't ask for in the first place?!?
Yes a front loaded loan is a very good reason for being misold. Again you could sar them for the paperwork necessary for pursuing a claim

Better to just put the complaint in if you have reasons:
I am currently switching credit cards and doing a balance transfer from this lloyds one. So would you recommend I follow it up once this has been done? Also, I called up to cancel my ppi and the guy at lloyds said my claim would be in jepordy if I cancelled my ppi...I should put in a claim 1st before I cancelled it? What did he mean??? Last question....after I have switched, how likely am I to be able to get hold of a copy of my actual signed agreement from lloyds? If it is still active, do they still keep them? Thanks in advance
You can cancel PPI on a CC there is no penalty as it is a monthly payment that can be taken off at any time.
Do the Sar request and wait until you get this info then do the claim for mis sell, the Sar can take up to 40 days and by that time the switch will be complete.
Ask for all info they hold on you and not just the agreement.
When you put the claim in, let them know what you were told when you tried to cancel this.0 -

Write back to them and ask for the info they found that proves you did not have PPI as you would like a copy.
If this account is closed you may have to send a Sar for all info they hold on you if you do not get any joy with asking them for proof.0 -
I have the loan agreements. There was never an option not to pay the insurance (it was included as part and parcel of the loan) and no final statements were sent to me.0

i'm after some advice, I contacted what was Additions now Very to claim back my PPI and have had a response saying my complaint has not been upheld, I know the next step is to refer it to the FOS but they have put a bit in there letter saying "Due to the rules and restrictions FOS are required to follow and as your policy was sold before 5th November 2004, it is our understanding that FOS may not be able to adjudicate on your complaint as we were not a member of a Dispute Resolution Service until this date"
I took out the policy upon opening the account on 23rd September 2003 and cancelled it on 29th February 2012.
Does anyone know if its still worth trying with the FOS or is it not wort while?0
