i got the ball rolling for a ppi claim with halifax last week, today i received a letter
"you were advised that you could get the loan if you had ppi" we are gathering infomation and will be in touch.
i told them on the phone when they asked why i thought id been misold "when i took the loans out i was told i could only have the loan if i had the ppi (no ppi no loan)"
1. have they worded this letter wrongly to use as a reason at a later date (and should i correct them)
2 can anybody who has succesfully claimed against halifax tell me if this is standard and what to expect next and timescales
3 a freind has told me halifax will refund me the ppi i paid plus intrest automatically, is this correct?0 -
Hi there wonder if anyone can help me with this? Took out an A&L CC in 1999 and in 2003 it was taken over by MBNA. Phoned MBNA to find out details and they started claim over phone. Within 8 weeks I had money from them , they said PPI was not mis-sold but as a goodwill gesture would refund all PPI from when MBNA took over. This has been paid. They stated that they would send details to original lender to reclaim PPI for 1999-2003. It has been some time now and when I phoned MBNA they said to phone Santander to find out how claim was progressing. Did this but Santander said they did not buy CC part of A&L so they are not responsible. Any thoughts as to where I go from here. Many thanks.
Hi Miffy give the fos a ring and see what they advise.0 -

Hi if they've sent a letter saying that you could have the loan if you had or took out ppi they've rather dropped themselves in it, as this is a good reason for a misold claim.0 -
Hello
I have just received a letter from LTSB making an offer re. my PPI claims. My claims are for 4 different loans which are now closed. I do however have an existing loan with LTSB which does not have PPI on it and which has never been in arrears.
I am worried that LTSB will use my refund to offset the loan that I have with them at present. The letter from them is quite vague but it tells me that it owes me an amount and will send me a cheque or pay "any monies owed" into my bank account. However, there is one random paragraph which has been written in bold ink which says that their personal loan service centre will send me a statement to show me the payments that they have made to my loan account and will confirm the outstanding balance on my loan. This implies to me that they are going to offset my existing loan with my PPI refund.
One of the loans I had was in my maiden name from 2004 and does not have anything to do with my existing loan. My present loan has never been in arrears and I do not have an overdraft or anything like that. What advice can someone give me.
Can they use this money to pay off my existing loan even with PPI refunds that are for completely different loans?0 -

Hi there
Firstly everyone's mis selling circumstances differ, but if you were told that you could only have the loan by accepting the PPI, then yes you have a good reason to complain and make a reclaim on the PPI.
If you feel you have missed anything, then you can send them further information of your complaint at any time, so they can also take it all into account. They should give you a complaint ref number.
The normal timescales if that of 8 weeks from the time they receive your complaint, but they normally send you a letter within a week maybe 2 to confirm they have received details of your complaint and let you know when you should hear from them next.
So this could be anytime from now to 8 weeks, depending on what they have to look into of the reasons you given them to make a complaint.
If successful, they should uphold and refund you all you paid of the ppi premiums, plus the relevent interest paid per month, plus an extra 8% interest of what a court would award.
They should calculated the same as the Financial ombudsman service (FOS) calculation guidelines.
And, they should send you a breakdown of what you should expect to receive.
Hope this helps, good luck.;)The one and only "Dizzy Di"0
