  • Hi,

    I have sent off letters to all of my card and loan suppliers around a month ago, I received a letter back from Santander around 3 weeks ago saying they're upholding my claim for misold ppi and would reimburse me 4000:j. If replied to within 2weeks then the money would go straight into my bank. It was returned straight away recorded delivery. How long should I leave it before contacting them as no money has gone into my bank. As yet have had no letters of confirmation from any of the others! :o

    Would the banks I am claiming against know this or would I have to inform them?

    I received a letter from capital one after 7 weeks stating they cannot go further until i send proof of identity ie copy of passport or driving licence.
    Is this a good sign of me having a valid claim? or just another way of dragging it out

    Not necessarily. If whoever you claimed against was forced to write of any debt as a result of bankruptcy then they will almost certainly retain it. In those circumstances it is likely that FOS would hold that it was "fair and reasonable" for them to do so.

    You could, in theory, take them to court. In those circumstances the court might grant them the right to set off but would be more likely to find in favour of the firm over the PPI complaint - meaning nothing at all would be paid.

    Thanks for your advice. I'm not too sure to be honest as it was a while ago and the official receiver dealt with it all so not sure if they were forced to accept the payment. It just says on my credit report, settled with full and final payment so just wanted to know if I was successful if I would still get paid out? If that makes sense!!

    I'm not too sure to be honest as the official receiver dealt with everything and after the sale of my house my loans ect were settled. On my credit report it says "payment received as a full and final settlement Although the payment would not fully clear the balance" and the status in settled. so just wondered if I was successful would I get any money back?

    They have eight weeks to respond with a full and final letter, after which you can go to the Ombudsman. Usually, you'll receive an acknowledgement before that time, with another letter to update on progress. However, the latter two stages are not compulsory and many just get the full and final response.
    If you're worried that your letter has gone missing, post it again with a cover letter explaining the circumstances. Remember to post it Recorded this time and track it's progress with the Post Office!

    Still no letter. BUT i did get my bank statement and 3 days ago there was a PPI plus interest Repayment of £7,000 :eek:

    Thanks very much to everyone who has helped with keeping the campaign alive constantly banging on about it including threads like this one. If it wasn't for the quarterly or so emails from MSE, I really would have left it. As it was, one quick phonecall, one questionnaire, and 8 weeks to wait. Stunned. Now to start another thread elsewhere on how best to use this money to tackle my credit cards and reach my goal of being debt free :) Cheers all and keep trying to everyone still waiting.
  • Further to reading a thread on another forum, and then coming here via the link that was posted, I made a claim to Lloyd's TSB in February. I have had several loans with them, a mortgage and a credit card, all of which I was paying PPI on.

    I have had some letters from them recently. One saying the credit card PPI was not missold :mad:
    Four separate letters for differnt bank loans offering me £9200 in total :T:j:rotfl:, but with a postscript on one saying that they could find no evidence that there was any PPI on my mortgage. I have since found a couple of statements from that time which clearly show MortgageSure on the account, and I can clearly remember the conversation with the Bank Manager regarding me having to take it out because he was loaning me over 3.5 times my salary and the bank needed it as a surety. Anyway, that aside, I've faxed over copies of the mortgage statements, but am concerned that they will use this further information as an excuse to hold things up for another 8 weeks.

    Does anyone know what the procedure is; I have accepted the offer on the four ban loans. Will they pay this now and follow up with the other one, and if so, how long generally does it take for the money to appear in your bank account?

    And with regard to the credit card PPI, I have written back explaining in greater detail why I think it was mis-sold, basically that I felt pressurised into taking it, and was told that I would be totally uninsured if I didn't, and that I was not informeed that there were other PPI policies available from different companies should I wish to get a quote from elsewhere. Was this the right course of action? And is it likely that they will pay out?

    It seems strange to me that they have paid out on the loans that were concurrent with the credit card but not the credit card itself, and that one of their reasons was that due to selling practices at the time...surely they had the same selling practices for both loans and credit cards?

  • I had a mortgage with Bradford and Bingley with which I was sold PPI. How would I go about claiming? Would it be Santander or the Financial ombudsman? Any ideas?
  • hi , i asked for info a while ago on ppi. I got onto tescos and they wrote me a letter saying i didnt have ppi (which i know i did) so i got all info together for the ombudsman ( still yet to post) and last week i receive a letter from tescos saying they are awaiting more information and will be in contact with an answer.... i have tried calling the number for tesco ppi service but it doesnt work :) would you think that i may be in with a chance and to hold off sending info to ombudsman or should i send it. Thank you
