Not been able to post, but been keeping an eye on your updates. Hang in there, it sounds like things are getting organised. As someone else said earlier, it's bumpy at the start, but it does settle down.
As for you question - try this: Your original agreement with MBNA was to pay them (example) £50 per month. Now you've told them that you can't do that due to financial difficulties. MBNA are happy with that, but they've still got a CCA agreement with you that you're not meeting.
Eventually the arrears will hit a point and MBNA will decide to register the default. It might then go to a DCA - I've got no real experience on this bit, but the DCA's generally accept the payment plan. You just pay them instead.
That's only my interpretation of it so could be wrong. But don't worry about it! If you can only afford £10 a month then that's all you can afford. Get your plan up and running, get a good nights sleep EVERY night...then worry about the default!
Thanks Magi74,
Great post, someone as clueless as me can even understand that!
Cheers

I found that charges were added to my balances until my DMP was in place. It was an interesting experiences and I am only now realising that the first payment Payplan sent was actually prior to my DMP been accepted - so it was a type of token payment - had I realised I would have sent them all a pound each instead of the larger amounts sent by Payplan:mad:
However, what's done is done. So you will probably get charges until your first official CCCS payment AFTER acceptance of your DMP. Unless you are very lucky I guess.LBM August 2011. DFD somewhere post [STRIKE]2025[/STRIKE]2022

spoke to CCCS today and queried am I meant to make a 2nd round of £1 token payments to my creditors as they are starting to send out "your next payment is due by xxxx" emails, well Barclaycard anyway and RBS have slapped a £12 late payment on my account even though I sent them a £1 token postal order, which they have credited against my account
CCCS said not to worry as they will be all soon be getting a slice of my DMP monthly figure that is due to come out of my account on the 1st March (after the creditors are expecting payment off me). They won't get their slice until March 25th when CCCS give them all there share
I may owe £27k, but have never missed a payment in my life
I know my credit record is now shot to pieces by being on a DMP, but I am getting stressed now as I don't want "none payment received" showing up on my credit file
I am sorely tempted to send them another £1 token payment each.
Anyone else been in my situation please?
Thank you.
Can't breathe properly again, getting so stressed......
I also asked CCCS if I needed to send them copies of letters I had received from the creditors, as I have been scanning them in at work and emailing them to CCCS with my DMP ref. number, the girl seemed quite blase and said you can if you want, but you don't have to as long as you keep a copy for yourself. Very reassuring
Do my creditors also send the same letter they send me to CCCS then?
Getting very confused and not sure what to do
She also asked if there was any money in my RBS account, I said no, I'd transferred it all to my new account, just leaving the £198.99 overdraft amount owing.
She said good, we'll now write to them. But I still haven't written them my I am in deep doody, going on a DMP with CCCS and here's a £1 token payment towards the overdraft.....
I still can't get my head around this tiny overdraft being one of my debts, and CCCS will offer them like 74p a month until cleared
Need a lie down, no honestly
Bad evening, can't explain, bye.......0 -

It will all work itself out in the end RG.
No amount of you worrying is gonna change much so why bother. Change the things you can and get over the things you cant! You changed your financial situation by handing it over to cccs, good decision! You cant change the fact that some creditors will only get paid a small amount, so dont worry about it!
I havent told my bank that I am on a dmp yet (until I am free of them) and cccs are doing the same with me. Waiting until everything has been transferred to new account before they give them the good news!! haha
You need to concentrate on making this new budget work for you. Its probably gonna be tough and you are in it for the long haul! Keep your chin up....its got to get easier...right?0 -
I have to agree with scaredsick. You've come so far, but seriously you need to calm down. I know its a cliche but it is just money and you are sorting your debts. All of us have been there or are still there. I have a slight wobble if I have to use the overdraft (which I'll have to do on Monday as I will only get paid Tuesday) but once it was much much worse, and I had a pile of overlimit letters. I've kept a few to remind me of my low points. Seriously don't let your health suffer - these companies are multi million pound organisations and make even more millions from late payments etc. Hence don't worry about them and let CCCS take the stress. Remember you will be debt free! Then you too can have a slight wobble about going £30 into your overdraft!0

I'm with the two posters above - your health is more important.
Sometimes you need to let go. CCCS are sorting it out and they're great. At the moment you're just going round in circles and that does nobody any good.
Best of luck hun!

Just a quick update from me, got home and had two letters awaiting me.
The first was a RBS Mastercard statement stating:
"Your account is in arrears. Please call 0870 xxx xxxx today to make a debit card payment of £79.55 or to discuss your financial situation and how we can assist".
I thought what arrears?, until I checked the statement:
Previous balance = £3,580.02
Payments to your account = £1.00 (the £1 token postal order payment)
Spending on you a/c plus any adjustments = £282.50
NEW BALANCE = £3,861.52
Pay overdue sum £79.55 now, remainder as below
It then breaks it down as showing a £100 payment I had to make for my rent on the card, plus a £100 cash withdrawal I needed to live on until I got paid, bad mistake I know. These were before I contacted CCCS. It then shows a £12 late payment fee, even though they credited my £1 token payment to my account BEFORE this late payment fee. Then two lots of interest, and now a £12 over limit fee.
You have failed to make a minimum payment.
Failing to make your minimum payment can mean that you have broken the terms of this credit agreement and could result in us taking legal action against you. It could lead to you having to pay additional costs and make it more difficult for you to obtain credit in the future
So now I am getting stung for late payments I made (albeit a £1 token payment), and an over limit fee of £12.
I am so annoyed by this I don't even feel like phoning them up, and just giving it to CCCS for their records, but its my fault I know.
Secondly, I have had my latest OPUS Card statement showing:
Previous balance = £1,675.49
Payments & credits = £1.00 CR (the £1 token postal order payment)
New transactions & charges = £0.00
Closing balance = £1,674,49
Next months estimated interest = £0.00 :j
Payment information
Minimum payment due (including missed payments) = £46.35
So, it shows the £1 token payment, and states charges = £0.00 and next months estimated interest = £0.00, but why does is state £46.35 for the minimum payment due?
Surely they have frozen the APR at 0%, but haven't had anything yet from CCCS, or have they? The interest shows 0%.
I just wish these creditors would write to me (as NRAM & MBNA have done) saying they have frozen the interest and accepted the monthly offer from CCCS, or are rejecting their offer.
I need to know one way or the other
I still have heard NOTHING from Barclaycard or the RBS owned MINT Visa card companies
What do I do?, scan in these 2 statements and email them to CCCS, or contact RBS directly and explain I am on a DMP and can't afford the monthly payments hence making the £1 token payment, and while you're there, please can you freeze the interest and stop the late payment and over limit charges?
They'll not listen to me.

Hi
Been lurking on your post for a while to see how you are doing! I am also on a DMP with CCCS and the first month was HELL!!!! but trust me, once this month is over you will wonder what all the panicking was about.
I takes them about a month to get it all sorted for you. Your creditors will send you letters regarding registering a default on your account because they have to. They are standard letters that they send out. I almost had enough of these letters to fill my re-cycling bin!!!!
I have had no problems with my DMP since I started it in July 2010. Our quality of life is so much better, yes we have to watch what we spend but hopefully we will be conditioned to do this for the rest of our lives and never get in the huge mess we did again.
Good luck and keep calm!

You used the card before contacting CCCS. I would therefore be inclined to allow CCCS to contact them first. They may not accept your DMP, and could try for a CCJ against you, but to be honest with the associated court costs this is unlikely. If you want to contact RBS I would simply tell them you are unable to afford the minimum payment. They may then hold off until contacted by CCCS. Remember though banks are there to make a profit, and they may continue to send letters etc to apply pressure upon you, but they can be accused of harassment if it becomes vexatious.
Good luck, hope all goes well!0
