prophet - does your work have a union?
Lets just say a few years ago I done something which was a sackable offence, and I had no doubt I was a goner, but the union managed to get me out of it with not a mark on my record!0 -

Hi Alias 7, no we don't have a union although there is one I could have joined and one of my colleagues did actually join and advised us all to! If it does turn out that I go back I will join one and get a pack for all my colleagues as well, not sure what will happen this week but I will post as soon as I hear

Interesting thread.
As sazzacat has said, your manager should no longer be part of any investigatory or disciplinary hearings. In fact, as soon as that had been brought up in the meeting it should have been adjourned and that investigated separately. Your investigation had become tainted at that time (your manager could very well have misrecorded the minutes) !!
Assuming you are still suspended pending investigation. Enjoy the time off, as I am sure you will be back in no time.
I wouldn't be surprised if you wanted to call in sick because of all the stress !!

There's no point in calling in sick if you are suspended - it simply blights your sickness record. I'm surprised your employers are still standing, the number of times they have shot themselves in the foot already.............:oEx board guide. Signature now changed (if you know, you know).0

Prophet, I may have missed this bit - are you suspended from work on full pay? You're still not back at work? If you're still off on full pay, I think that you should relax and enjoy it. I truly think that you've got nothing to worry about, and I'm with jobbing musician. If they take this further you will take it to appeal, and should you lose, you'll be in a tribunal. I bet you'll never be given such an opportunity again to be at home on full pay, you should enjoyt it!

Your question about the policy - it's quite clear that the company is trying to reign in the internet usage, which has become commonplace. However I think they're going to have to go round and rebrief everyone as the policy is not currently effective. Kind of 'draw a line under the past'.
By the way, to the other posters - what Prophet's manager may or may not have done on Ebay is irrelevant to him being part of the investigation. He doesn't get disqualified from investigating someone else even if he has done something wrong himself. That's an issue between him and his employers, not between him and his staff.0 -
I may have misunderstood, but I don't think the previous poster was implying that the OP's manager should not be involved because of his/her Ebay trading. ACAS guidelines recommend that the investigator of a disciplinary should NOT be the line manager, but someone impartial

But as far as proving you did anything regarding accessing your managers mail then good luck to the company (and I run a technical support team - specialising in security software!)
If everyone logs on and leaves machines logged in then this should be addressed as a company wide security breach and is a training issue - they can't slap you for it. Sounds like they are so far down the path though they don't want to admit they are wrong - stick to your guns and enjoy the paid holiday
I know I would if I knew I wasn't guilty of what they have claimed (Oh and the cookies... really wouldn't worry... tracking EXACTLY where they come from is notoriously difficult and if there is no surefire way of proving it was you at the terminal then they haven't got a leg to stand on).
