Hi babe, really glad it's gone the right way.
No, you won't receive an apology. The company has done nothing wrong. They have investigated what they thought was serious misconduct (it was def. not about the internet use but was about the manager's email - suspension should only be used in suspected cases of serious misconduct or gross misconduct) and found that you did not do what they thought you might have done. Therefore no apology is needed, and it won't be forthcoming.
I know it's stressful to be investigated, and very worrying, but they've looked into it and your name has been cleared.

I would return to work with a letter somethign along the lines of:
Dear Mr XYZ,
Following your communication dated x/x/x requesting my return to work today 12/03/2007 I assume that you have investigated and found the allegations against me to be false, like I told you when you initiated this investigation. I would therefor like a written confirmation confirming this and that all charges were found to be without merit and thus dropped.
Whilst I appreciate that all allegations have to be fully investigated I am appalled at the lack of professionalism I encountered from the company during this investigation and I will seek legal advice regarding my position within the company.
I would also like to lodge a formal complaint against the person who made these accusations as obviously this is victimisation and slander and I want this fully investigated.
I can not make clear enough the stress and concern the company have caused me through lack of following proper procedures and acting ethically through this incident and can only hope that no other employee will ever have to endure the sleepless nights due to such incompetence in handling complaints.
I look forward to the written appology at your earliest convenience, to be no later than close of business 14/03/2007.

And this is a complete and utter waste of time and would cause you a lot more problems in the future, ie mark your card as vindictive and also as fairly naive and immature. Especially as there has been no hint of victimisation in anything you have posted on here (except for wondering if you were being stitched up, but no evidence of that of any kind), noting unethical, and there has been no 'person lodging complaint against you' and any legal advice you received would be along the lines of 'keep taking the tablets' - unless there is a great deal more that you have not posted here. (although their computer company certainly seem to be pathetically inept).

It's best to take the moral high ground in these situations.

Thanks CFC....I appreciate having another view on this and will have a good think about it.... the problem is that now I have got together with my collegue and we have seen each others evidence, there are some dates for the unauthorised email access where there was nobody in the office and therefore the terminals would have been switched off.... and also not everyone who could have accessed the emails was not investigated... so it has made me fuming. What is worrying about the evidence that has been presented is that presumably (especially as I did not access the emails in the first place) it could all happen again??? Also if they are under the illusion that all the cookies are web sites then even in the course of regular research I would be creating cookies that cannot be explained??? it is very worrying and unless they come up with a set of measures that will ensure I will not be implicated in the future I will be terrified to switch the damn terminal on!!!! I guess I will see what happens this week and report back

i dont really send any emails from work, but at lunchtime do have a look at this site, or order shopping online so surely there isnt a problem with that, i mean my work is always done first.0 -

Firstly, make sure that all your own passwords are kept securely and that noone can log on with your log on.
If you are concerned that the same situation could arise again (one would certainly hope that they'd make changes to their system after this, but true, you never know) I think that you should approach your line manager and discuss it. Whatever answer he/she eventually comes up with, request that you get confirmation by email.
Keep strictly to the internet use policy. It really is the safest bet in all circumstances. If you are concerned that there may be an issue with cookies because you are requested to do research as part of your job, again approach your line manager.
Do it in a very non - hostile manner, just raise the matters as a concern needing clarification for the benefit of both the company and yourself as an individual, because it is to the benefit of both. The company doesn't want to wrongly accuse people of wrongdoing because apart from anything else, they've just paid you to stay at home. Not cheap LOL. Plus they dont want to demoralise people because you get less work out of them afterwards if you do that. It's to your benefit because it will reassure you and other colleagues who are also concerned that the defective IT information that the business were given will not be given credence in future, without fundamental changes to their system..
The answers should make you feel more comfortable, plus of course, you keep the emails, just in case.
In a way it really doesn't matter why you were investigated and other people weren't. It could be as simple as yours was the name given by the IT company, or they may have given a range of names and after investigating you decided that it would be pointless investigating others. But again, in a non-hostile manner you could ask your line manager how many people have been investigated over this issue and are they any closer to finding out what actually happened? It's not any information that you have a right to know as no action has been taken against you, but the company are very likely to answer your questions if you approach it in the right way ie as a 'concern with questions' rather than an 'emotional campaign with demands'.0 -
Hi again cfc... thanks for taking the time over this... It will be very interesting to see what the atmosphere is going to be like as my line manager I am sure will have been spoken to about undermining the internet policy as he gave permission. I also did implicate him at the invetigation meeting as he was most likely to have been at the termianl when another managers email was accessed as I had gone home. I was not saying it had been done just that the evidence was not realiable. I asked if Everyone had been investigated and I was told no but that this would happen. We are supposed to have a meeting with another manager up the scale this week so don't even know what this is about..... I'll let you know.0
