  • I actually got done last year for selling copied dvds in work.. i brought up the fact that if you sack me then really you need to get rid of the staff who bought the dvds.. this included managers. They had a list of orders off my my email.. as soon as i mentioned that then realised what kind of trouble they would cause by doing that. I had a slap on the wrist and have never sold another copied dvd since!!

    If you feel other members will need to be investigated then say something..helped my case!
  • Hi Richie23, I think this is a really good point and I have sort of intimated this already but I am propbably going to have to raise this as a formal grievence that other people have accessed including my manager and three people were present at an email access that haven't been investigated. Then if it does go to a tibunal and can bring in the fact that I have not been treated the same as other people. As I am the only part-time worker on flexi time I might hae a good case. I think two of these people have since left so was sort of told that they could not be investigated... but it looks like they had the information about email access around the beginning of January when they would have still been in post.

    I wonder when would be the right time to raise a grievence..... before the dsicplinary (if it gets that far) at the disciplinary or now before it gets that far????? usual heart felt thanks ifanyone can answer that one

    They might be doing this to scare you.. mine was slightly different as i was doing something illegal so when i walked into the meeting i saw a notepad with the words 'Police' circled.. it worked..definately scared me.

    They even printed out what they did with you about internet sites i'd visited and I just admitted to it but added and questioned...
    1. ok so i admit ive been on the internet but me being on the internet has it affected my work? you only checked my internet usage because you investigated someone elses email and noticed an email off me saying kindly that they still owed me money from a month ago. so one; i wasnt hassling anyone for payments, two; if you didnt check that persons email you would never have found out about me selling dvds. If however you didnt found out that way and clearly thought i wasnt working hard enough and then investigated me then fair enough.. but i have always worked to my best of ability and only been on the internet when quiet, it hasnt affected anything what so ever..clearly because ive been doing it for over a year and you've never picked it up.

    i dont see how your company can just pick on you if other people use the same pc with the same internet password.. its scandalous. And if people lock their own machine then they should be getting the same treatment they are giving you as thats breaking company rules.

    Personally i think they have got no chance of dismissing you with the evidence they got and the circumstances.. they are talking about you wasting company time.. what the hell are they doing now then withthis business with you???

    Hi Prophet, don't raise a grievance now because so far you have not been treated unfairly and had detriment from it. This would be a matter that you would raise in any disciplinary hearing that arose from this case.

    I have been charged with accessing my managers email which I have not. The computer terminal I use can be used by other people and my managers also use it. At times I have switched on the computer and because she/he has not logged out properly there emails have been there, however the company are saying this has been taken into consideration and it has beeb accessed in a different way???

    My understanding of this is very basic (so best to get more advice on what I'm saying) but here goes...
    Every computer in a network should have it's own ip code (which is different to an ip address, which is used for access to the internet). It should therefore be possible to find out which computer the culprit is using (if it's not coming from your pc, of course).

    Also, does your office have cctv? If not, do you have an alibi for any of the occasions the internet/email usage took place? Ie, were you in a meeting or off sick/on holiday, for example? Surely for them to prove it was you, you would have had to be at work/at your computer every time ebay etc was accessed. It might be worth working out which days you were elsewhere. I may be seeing this wrongly but I think they have to prove it was you using it (especially as other people have access to your pc), and you're bound to have had alibi's of some sort at some time. It could well be a positive thing that ebay was hit so many times.

    Your employer may give you a copy of the history (I'd insist on it if they were using it against me) and that may help you to work out where you were at the time, you were obviously somewhere - maybe even with a manager!

    Yep final written i got.. all in the past now and havent sold one since. They couldnt get rid of me either as i was the only one working on this project and knew about it all.. soo yes i was very lucky. It affected my appraisel for that year.. should have had a 5 (which is perfect) but got a 4.. which is still pretty good and hard to get but as i was working all hours god sent think they realised the'd b up the creek if they sacked me. And for the wages I was on and to get some one else to do my role they'd have to double the wages!!

    OMG - my line manager even gave me her password to sort out some stuff in e-mails sent to her and has often since reminded me of it in case i need to look at anything...

    what an awful story, it's a bit worrying that and in future i'll be reading magazines at lunch instead of MSEing...

    All I can say is that when it comes to computers. They always know what your upto in work.

    One day in work I got to see just how much the techical people can see. They can basically work on your computer and you dont know........ Imagine if you where doing something on the computer and basically someone was watcing what you were doing. Except they are sat in the next room.

    Its realy scary!!!

    Iv always just dont my work and a bit of MSE'ing but some of my mates have been looking up "Interesting" things. Needless to say they dont work here anymore!!!

    Oh well Richie, at least it worked out in the end. You didnt lose your job or anything and this will all blow over after a bit...

    Where I work, before IT engineers can access my PC remotely, I have to okay a message which appears in a separate window on the screen. Unsure whether they could access it remotely without that though.

    Thinking about it .... I don't know how I know they've stopped looking at my PC from elsewhere cos nothing comes up to say they've gone !!! Might have to check next time this happens.

    To the OP - are you suspended currently, sorry I read most of the thread yesterday and have just read the new posts today and can't remember. Hope it's on full pay if you are.
