Glad to hear things are going well for you. At any more meeting etc insist on taking a representative with you as well for witness purposes etc. This could be colleague union rep or anyone (i think) You do have the right to have someone with you. Perhaps you could take someone wiht you with knowledge of computers etc.

    Keeping fingers crossed for you

Well just got to sit and wait while they decide if they are going to take it any further after gaining more evidence I'm sure they will). At least i should soon get a written account of what I have actually been charged with. I don't feel as frightened as I did thanks to everyone's support. I shall keep updating when anything new developes many thanks

Somehow I think it might run out of steam if things could backfire on the accusers.
The managers are relying on technical evidence which should be confirmed by "Expert Witnesses".

In the last few years the evidence & reputation of many Expert Witnesses & their role has been called into question in many court cases.

well.... the meeting was very interesting and with a much more softly softly tact.... they have not mentioned anything at all aboout deleting history and are concentrating on the email access and ebay access. At the meeting though I was able to state that on one date given I was not at the terminal but my manager (who was there taking notes) was in the office and I hoped that all four staff who were in the office that day would have been investigated. This caused a bit of a fluster I think becasue this has not happened and I think that two of the staff have since left without being interviewed about it. As far as the ebay access goes because I was given permission, I was given no specific guidelines at was constituted appropriate access, my work was not effected in any way.... so I think it it did get to a tribunal its possible that things would go in my favour... they wre not able to tell me whether a 'hit' constituted a visit or a page..... I also asked quite a lot of questions thanks to this thread so there is lots of information that has to be gained...... Looks like I just have to sit and wait again until the next lot of information comes through cheers cheers cheers

Hi Prophet, it sounds to me as if it went very well and I think it's very likely you hear little more on this. There will probably be company rebriefs concerning internet access (reinforce policy and make sure that managers follow and enforce it rather than give permission!) I think the managerial email access issue will not come back to you again either.

Glad it went well, glad to have been of help. If you do hear anyting further dont forget to post again :)
  • Hi Prophet a hit is not classed as a separate visit to the site, so if you have 50 hits that could be in one visit.
  • You could try ACAS for some help. Their website is https://www.acas.org.uk and they give advice over the telephone and they also have some very useful leaflets (to take to the meeting). If you know your rights they'll find it much harder at work to confuse you with the technical stuff. Good luck!

Hi mighty reds, I had a feeling this was so especially as on ebay it is so easy to be looking at different things... I worked out that just looking at three items and asking a question would mean I would be clicking on about 20 pages what with logging in and all and the whole thing would take about 3 minutes. The thing is that at the investigation they hadn't even decided for themselves what a 'hit' means so these are all questions that now need answering. I have also been told I have been on ebay.com 470 times and I just do not go on it so I am wondering if ebay.co.uk creates ebay.com cookies??? its all so confusing.

... and dear CFC.... I hope you are right, wouldn't that be fab

... and deborah17, thanks for this...it is a great site and as they are following the acas guidelines at least Iknow what they SHOULD be doing.... I will post as soon as there is any more info
