Egg/Barclaycard PPI Claim Rejected-FOS next?

    Had a refusal from barclays for a egg credit card ppi, they are also saying i cannt take my complaint to the FOS because the date of sale was before Barclays became signatories to Code of Practise General Insurance Standards Council [21 Nov 2001]

    Yraunaj - ring the FOS about that - I spoke to them about a similar letter from Barclaycard quoting the GISC 2001 statement and the FOS said they'd had loads of complaints about this and they would take it on.

    I dont know if Barclays are right or not. Magpiecottage will be in a better position to answer that one. However, you do have to be a little wary of what the FOS say. Often the telephone staff will tell you that they would like to take a look at it even if there isnt a snowball chance in hell of it succeeding. So, don't get your hopes up there. It is just the standard response. As I said, Barclays may or may not be right. I dont know that bit.

    The issue of the GISC code is one which Barclays seem to regularly bring up - conveniently overlooking the fact that they were signed up to the Office of the Banking Ombudsman and so complaints against them fall under FOS jurisdiction anyway.

    However, if one firm takes over another's liabilities, FOS will treat the case based on the status of the original provider at the time. Thus if Egg was subject to the jurisdiction of the Banking Ombudsman (or any of the other predecessor Ombudsman schemes) It would accept the complaint for investigation.

    So you may want to go to FOS regardless and see what they say.
  • I have been advised that if i send £1 to Eg they have to send me my original paperwork. Is this true?

    I had a card for several years and am certain i paid PPI, the card account was closed in Sept 2005. I have tried Barclaycard and they advised me to write to the following, can any one offer any other contact information

  • I've had several PPI claims upheld and enforced by the FOS and got a very nice payment from Egg for PPI insurance. Do not worry if your loan was taken out before Egg was acquired by Barclaycard. That is immaterial. Barclaycard now owns it and must resolve the claim. Moreover, the Financial Ombudsman Service will resolve these issues.

    What you need is your "final" denial from Barclaycard. This is the letter that says that this is their final decision. Armed with this, you can go to the FOS. It is a very simple process. You can download the form on line. DO NOT GO TO ANY AGENTS OR SOLICITORS. THE FOS IS FREE AND THE FORM IS EXTREMELY SIMPLE.

    Be forewarned that it will take time to resolve your claim. Mine took 14 months, but I receive substantial pay-outs from Egg, GE Money and Loans.co.uk.

    Don't waste your time. Once you have your final "denial" from Barclaycard, you should file a claim with the FOS. They will sort through everything. I've gone through this. The FOS is great.

    I've just had a rejection from egg/barclaycard..I took the card out in 2003 via the online method and the ppi opt out method rather than opt in..I did have other reasons for mis sell..can I ask when I take this to the fos do I need to send them everything I sent to barclays? Which was a template letter from here and questionare as well as the fos questionare and copy of rejection letter??? I didnt state in my original letter to barclaycard that it was the pre ticked method so will I need to state this to the fos???

    If you do not state that it was pre-ticked FOS will not know.
