Refunds on items reduced in sales

  • And this is where we would agree to disagree.

We have seen a number of situations on this consumer rights forum where a company has sold an item, realised it was the wrong price (too low) and has called up (or even chased the customer down the street) to ask the customer to pay the difference. Obviously since the deal has been done then the change in price (whether up or down) is irrelevant to the outcome of the situation. Unless there is a returns policy or DSRs that come in to play, there is no legal right for EITHER party to ask for more or less money after a sales has been agreed - whether the price rises, falls or the seller realises they accidentally sold for less in error.

Hence it appears to be a perfectly apt example and the answer to both situations is the same.

It is often delivered in a somewhat facetious or sarcastic manner but it goes to underline what a stupid question it is to ask in the first place.

That's the point. It's not a stupid question if, in your words, "there is a returns policy or DSRs that come in to play"
One important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.

Well, that's where I'm coming from. When people ask if they can return as the item is cheaper, the "would you return if it was more" is irrelevant as there is no set of circumstances where that would be appropriate. However it is quite likely that there IS a way the consumer could get a refund based on various other elements.

That's why it is not helpful
Unfortunately the OP didn't ask this, nor do the countless others who start similar threads. They ask whether they can be refunded "the difference", which is why the usual response is more than relevant imho.

It's not relevant. It's facetious. The correct response would be to ask more information. ie was it bought instore or online, and what is the returns policy for the store.

  • It's facetious and relevant (until the additional info suggests otherwise).

Well, the helpful thing to do would be to ask for more info so we can give the best advice :)

It may be a facetious response but the question in the first place probably deserves it.

Is it really that difficult to think for a minute before posting, "I wonder if I return this item (if possible) I'll be able to get a refund and purchase at the cheaper price" rather than keep posting the same old question as to what rights I have to force the retailer to refund the difference on items I've purchased that are now cheaper.
  • A new topic for the FAQ perhaps?
