As you pointed out earlier "So if you say yes and they say no, bearing in mind they hold the keys to the safe, what is your next move?"

In practice that is a possible outcome. The terms and conditions quoted say one thing, the website offer preamble to the terms and conditions, as a matter of fact, mentions "salary" as an example of a "regular payment", though it seems to me that Halifax could only find out if the applicant declared a regular salary payment on the .pdf form mentioned in the website offer preamble. It is reasonable question to what extent (if any) the preamble influences the interpretation of the following terms and conditions. And anyway not to declare a salary may influence the granting of a credit-scored type of account.

So I think your earlier comment is right. I also think the suggestion just to try applying again is not unreasonable advice.

No wish to prolong this but the Halifax website does not refer to salary as an example of a "regular payment". It refers to Salary as an example of "regular credit"
As you pointed out before in your post #5

I applied & was told "Sorry you dont qualify, have a basic account instead (no £100 & no £5 per month). I wonder how many people they have said this to in order to get out of paying the £100?
I want to switch accounts anyway so applied for that one - that was on the 3rd January & each time I call them & ask about my application they completely arent bothered by it & just say it takes 10 days to do this & 7 days to do that etc. They cant even confirm that I've sent back my details. Beginning to lose hope that it will be set up before my wages go in at the end of Jan & may just go somewhere else.

If by "basic" you mean the Halifax Current Account - its also offers £100 if you switch. As per halifax . co . uk/bankaccounts/
    What are Halifax playing at?

You obviously do want to prolong this. I understand your nitpicking but what is it about "the website says "You must transfer all your regular payments and credits across from your existing account using our Switching team" and elsewhere gives an example of "salary" as a "regular credit"......"" which is not clear?

The operative term is "regular payments and credits". [NITPICKING]What that means depends on whether the adjective "regular" applies only to "payments" or also to "credits"[/NITPICKING].

My argument has less been that the terms were "not vague" (I guess I strayed "over precise" in my argument), but rather that the terms are unclear and contradictory (as others have noted).

And as you skate over because it is inconvenient to your argument, the influence on interpretation of the very clear preamble.

I am not skating over anything.
    The T+Cs are clear.
You have somehow managed to put an incorrect interpretation on them in your earlier post.

The website does say on one page
"You must transfer all your regular payments and credits across from your existing account using our Switching team" and elsewhere gives an example of "salary" as a "regular credit"

    I have never disputed that.

But as that page is not part of the T+Cs its contents are irrelevant.
If it was a condition it would be impossible to fulfill as there is no mechanism for the Switching team to move credits to your account. Credits can only be switched manually by the account holder.
  • Salary MUST be credited to the account for the switch to go ahead. If salary is not transfered (or any other bacs payment, not a transfer from ur other account) then you wont get the £100.

At the moment ive been seconded to the account quality team and have been removing a number of £100's where people have basically lied in the interviews to get the incentive.

All direct debits/standing orders must be transfered

Salary or benefit must be transfered from old account to the new.

    1. What if your old account doesn't even receive a salary?

    2. You should suggest to the men above that they write their T&Cs better in future so that discussions like this don't need to take place.
  • To me the t&c's are clear they state all direct debits and regular payments must be transfered. If you choose to interpret that differently well thats your choice but its clear.

If your old account doesnt receive a salary or benefit then you arent eligible for the incentive

I've had Santander say i need to bring my salary over for their £100.

Turns out no i didn't. Didn't transfer my salary & still got my money.

** I understand it's 2 different banks & that Santander may not be as strict as Halifax.

Where in the t+c's does it mention that a salary or benefit is required?
All that is required are regular payments and DDs to be transferred as you have stated.
Regular payments are standing orders DDs are self evident.

no, no they arent. Regular payments in the terms and conditions are referring to the salary or benefits.

In the interview you will be asked for the details, if they are not given then you dont get the £100.

Are you just annoyed that a bank isnt going to just give money away for no reason?

If you dont wanna do the full switch dont, but dont expect the bank to pay you for it
