hi so as below ihave sent off a letter basically telling them that i reject the offer and im taking them to court, sent it last thur. every day since fri they have phoned me now i work nights and i was most annoyed at being woken so today i phoned up and politely explained that would they not phone me but write in stead as i work nights and dont want to be disturbed in the day or while i was at work. she said there was a discrepency in my figures and that she would send a statement of all my bank charges and a new offer. i explained i already had two of these statements and that she was quite welcome to send the letter so i could review the info.
However i made sure all the figures where correct as i know this could affect my case ??? i dont understand ?
Now what happens here i set a deadline of 14days as the standard letter is on your website does this still apply or does it renew everytime they make me a new offer.
i want to wait untill i get the full amount with interest which is over 1000 pounds now.
After telling them that they made the mistake in the first place (read below)and them ignoreing my requests to phone another time im just a little miffed at the customer service and im glad im no longer with this bank they have been a pain from start to finish.

MANY THANKS TO EVERYONE THAT HAS HELPED ME IN THIS ONGOING SITUATION.ok so i have got my charges letter with all the charges on i calculated they totalled to 745 without tax and 990.89 with so sent off letter asking for the money back with tax and recieved a letter saying that they had calculated the charges totalled to 770 but would offer me 385.
ok so here is my questions
should i phone the bank up and ask for a list of the bank charges again? i dont understand where this extra 25 has come from ? i have cheacked and double cheaked on the statement / table they sent me.
if they are correct should i revise my offer to include this extra money and would this affect my claim? or even the start date of my claim
i am unprepared to accept their offer and want to know do i recalculate the tax for the letter taking them to courtok i think that is it im so confused i dont know what to do plllleaaase help me

hi i had no problems, did you send the letter registered mail (the one you have to sign for?) cos sometimes letter get lost and ive heard of that happening alot especially when people are asking for money back from the bank.0

You can take them to court anytime. You should wait the 14 days you gave them but you can wait longer if you want to wait for their offer. The only discrepancy in their and your figures I can think of right now could be that some of the charges might have hopped behind the "older than 6 years" timeline since your last letter to them.Reclaimed thanks to this site:

but i thought that from the time you made the claim all the monies stand from that time??
im confused.You can take them to court anytime. You should wait the 14 days you gave them but you can wait longer if you want to wait for their offer. I simple pointed out that they would save £xxx if I didn't take it to court and asked them to live up to their name!!!!!!! Well Well!!! got a letter on 23rd june offering me not even half of what i claimed for, waited till the 29th june phoned them saying i need to discuss why this is not even correct, and basically said if i did not get a phone call back by the end of business that same day i would be starting court proceeding today at 9.00am. I was assured someone would get back to me.
Guess what ,heard nothing ,so just phoned them to say if nothing is sorted out now straight after this phone call i will be going on the moneyclaim website, and they apologised that the amount was incorrect in their letter and on the 29th they sent out a second letter offering me £1300 pounds!!!! only a hundred pound less than what i asked for back including interest!!!!
I am a happy man. I could not help having the final word and saying it's not very helpful when no one bothers to call me back etc..
So dont give up guys keep plugging away

ok so i have a claim for 770 or 1039.75 with interest but now i learn that because intelligent finance are in scotland i can only claim 750 and 5years of bank charges!!:eek:
i dont know what to do ?????? any advice. im due to take em to court tonight.

Do you live in Scotland? If you do then yes you can't use MCOL and the limit at small claims is £750.
However if you live in England and you mean you are filing on MCOL tonight, you'll find an address in England for IF in the Reclaim Help Thread, link in my signature.0 -
