    OP, you should find as you have the child 4 days of the week, you will be classed as the main carer\parent. He can whistle as many demands as he wants, he is not entitled to a percentage of a benefit, the benefits office dont work that way.

    As above, tell him to do one, if he wants to fight it, let him. Just see how far he gets with the benefits office, should he want to take it to a court, it will backfire on him terribly and will ultimately find himself worse off as a result.

    Try not to let him stress you out over it, Bite back!!!!!

    i don't really care about NRPs, but one pathetic stereotyping , pile of rubbish comment deserved another.

    when will people realise that there are faults on both sides instead of trying to turn threads into a one-upmanship contest

    My ex tried something very similar, I'm not on benefits but get CB For both children (obviously) and DLA for our son, the ex is a gambling addict (hence he's the ex).

    Daughter was on 50/50 split and son was going over 1 day a week - He demanded full CB and 1/7th DLA to cover the nights he had the children despite never having paid maintenance. I looked into this legally & he did not have a leg to stand on, I was informed that even if he took our daughter an extra night a week he would not be entitled to her CB as I would still have legal custody. I was also informed that financial abuse is a recognised form of domestic violence and as such his actions would be viewed dimly should the matter be taken to the court.

    I reported his demands to my son's social worker so they are on record if he attempts anything similar in the future and would suggest you do the same if you have one.

    OP, presumably you get the child benefit? That means you are the parent with care in law. That means you are entitled to maintenance from your ex (the nights the child stays with him will be taken into account, but still you will be entitled to maintenance). He is NOT entitled to any of your benefits.

    To people on here who don't agree with this - take your comments to the DT or your MP. This is not about what you *think* should happen, but what the law says.

    Looked at the posts and think I must be missing something. NRP pays £100 pm for his daughter and NIL for HIS son because the lad stays with his father for 3 nights per week? Seems on the face of it he's getting off lightly, although what used to be called the CSA (not sure if it is now) would make a maintenance award based on nights spent with each parent. Question I have to ask is why doesn't OP get a formalised maintenance agreement for both children? Both parents have rights and responsibilities here ... (speaking as a former client of the CSA) - happily no more :j

    £100pcm for one child is disgraceful, and nothing for the son because he's doing what a dad should do and spend time caring and being with his son.??
    That makes me sick to the stomach.

    He thinks he holds the cards when in fact he doesnt. Whats the worse he could do when OP bursts his little bubble??

  • Presumably her only saving on those nights are a meal, lighting in his room and some soap and toothpaste. She still buys clothes and shoes, whatever his needs require etc. I doubt the savings amount to enough for a Chinese takeaway, never mind the oodles of teat money you imply she's getting.

    Just to be fair and re-reading the OP it says NRP is paying £100pm total.

    I still say NRP is in entitled to half the benefits, but inm this case that half should go towards making up the shortfall in his maintance payments.

    That may be your opinion, but it is not what the law says.
