Southeastern Railway charge me £20 penalty fare

emneedshelp wrote: »Hi,
Just to clear this up a little bit, there are 2 levels of penalty that you can recieve for not paying a fare. You can be handed a penalty fare (usually £20) which can be issued by quite a few railway staff, get your statutory time to pay the fine or appeal (expensive fares will never, ever be reason enough to uphold an appeal) or you can be given a notice which usually means that you get a court summons straight away as you have deliberately intended to defraud the railway (ie, walking past open ticket office/past ticket machine, hiding in loos on train, multiple penalty fares etc). This is where the £1000 fine comes into play. I don't wish to feed the trolls, but as someone who has the tiresome task of trying to get people to show me their tickets on the train I wanted to make sure that the lines didn't get blurred with alleged loopholes.
End of the day, you wouldn't get on a bus without paying the driver so why is a train any different? It's also not fair on other honest passengers who pay the full price to also sit in an often crowded train to go to work who fork out for their tickets day after day, week after week, month after month who will subsidise those who believe that they shouldn't have to pay for whatever (non) reason.

No point trying to offer good advice to the likes of ilovecandy and Geordie_Taxi. I have advised in laymans terms what the potential penalties at court are for any sort of ticketing offence, and most law abiding people here will see that as correct. However, the two names above seem to think that the rules don't apply to them. For the record though, a Penalty Fare is not a fine, and at court, fines are usually far less than the £1,000 maximum. Also, prosecution can occur even when intention to defraud can't be proved, it's just different legislation that dictates this.

Trust me, I have no alteregos. I don't need one because what I have said is based on fact!0 -
Thank you, I understand what you mean Stigy. I think that there will ultimately always be those out there who think they can walk on water where things like this are concerned-I meet enough of them daily unfortunately! Maybe one day face recognition will be used to stop these travelling...or god forbid something happens to them on the train and they need their ticket to prove that they were onboard to get their large insurance payout.....oh they didn't buy a ticket??....Thats a shame........0

Difficult to be an alter ego when we must have been typing at the same time......
Enough anyway, I'm new to this and i'm going to look at something more constructive.
Thank you stigy, and to you geordie_taxi, I hope youre not on my train on monday lol0 -

You are back-tracking, because you're worried that SET trains will be looking extra vigilantly for thieves. By typing a silly little disclaimer, you've proved this. Why would they do that? You said yourself I'd be laughed at if I dropped SET trains an email (and you called me inconsistant?). Having said that, they are interested in intelligence regarding thieves. We'll have to see. Also, you do realise you're still committing an offence if you travel beyond validity of your ticket or similar, don't you? Just because you haven't been checked, doesn't mean you won't be. Or are you of the opinion that something is only illegal if you get caught?0

Just look for the angry looking guy who appears to have no life and you will know you are on stigy's train, anyone who loves their company so much to defend them to the extent he does is clearly a joke.0
