Car Insurance: clean license, but still stung on SP30... WHY???

    Good question!
    It's ludicrious what the insurance companies get away with. If you had it painted red over the original yellow, it's modified and they'll charge you extra for that I bet!!!

    Where have you seen it is irrelevant? It is the crux of the matter.

    Your conviction is not spent under the Rehabilitation of Offenders until 5 years after the conviction.

    Forget it. I got the answers I needed from DVLA and Police.
    Rehab was mentioned here. God knows why, as you don't need rehab from speeding convictions.

    My license is clean.

    This is 100% incorrect. As many others have pointed out, the Rehabilitation of Offenders Act 1974 categorically states that the offence will not be "spent" in law until 5 years from the date of conviction.

    With respect, there is no point in you continuing to participate in this thread as you are totally wrong in your proclamations and are not taking any notice of those who know what they are talking about.

    Apparently not. I asked my insurer this before I went on a speed awareness course and they said that they didn't need to know if no points were put on the licence.

    You are quite right, we all know that your average call centre clerk and local plod are experts on the Rehabilitation Of Offenders Act :beer:

    The insurer could ask you for the name of your first dog if they thought it would affect your risk and what premium to charge you. They don't have to offer their business to anyone, so they are entitled to set their own rules.

    However in some circumstances they are legally limited to what they can ask - they can't ask for your race or religion, and soon they effectively can't ask for (or at least use) your gender. Another of these restrictions is that they can only ask for convictions in the last 5 years, because of the Rehabilitation of Offenders Act, otherwise they could ask for convictions over the last 20 years if they thought it affected your risk.

    The fact your licence is 'clean' is just a different set of rules that is applied in regards to totting up and losing your licence. It just happens to be a different value than 5.

    If I was wanting advice on matters legal those are the last 2 I would be asking.

    Tell you what, get your local plod to put it in writing that a speeding conviction fine is not covered by the Rehab of Offenders Act 1974..........I can assure you they won't.
