Car Insurance: clean license, but still stung on SP30... WHY???

    Honestly. I was done for speeding abotu 10mph over 50. Not an assault or drugs!
    It's a joke. And who is Kingstreet?

    Yes, you commited an offense so the act applies. He is a poster who told you this at the start.

    The offence hasnt expired, your license is clean however but that is not what the insurers typically as. Whether you choose to believe it or not is another thing.

    The the exception of select professions, it is when the rehabilitation period has expired.

    They're not asking whether you have a clean licence.

    They're asking if you've had any speeding convictions in the past 5 years.

    The offence occurred. I got £60 fine, and 3 points. The 3 points has gone. The offence has gone in the eyes of the license and the law as far as I am aware.

    That's all that happens when you are nicked for speeding.
    The 3 points are known as an SP30 - aren't they?
    The points are now gone. Expired.

    I'm amazed people think that this is a correct way for insurance to act. I've asked friends about this, and they say it is a con, a way the insurance companies can make extra money, just making up their own rules.

    If I take my license into the Police - are you saying they would run a check and tell me my conviction still stands? That it has NOT expired? Happy to test if you like.

    They're asking if you've had any speeding convictions in the past 5 years.
    Correct, they all do.
    But if it has EXPIRED, how is it relevant now?
    You get stung because it was there within those 5 years.
    But in the eyes of the law, the offence is now gone. It happened, but has now gone, and the points are expired/removed.

    So to insist I tell them, then be stung still, during a clean license, is inappropriate.

    Of course your friends will agree with you. They're your friends.

    You are mixing two separate concepts in order to try to justify your argument.

    The law states two separate things:

    1. points no longer count for disqualification purposes after 3 years, and can therefore be removed from the licence after 4 years. This is the only relevance of points - i.e. whether you can be disqualified under the totting up provisions.

    2. convictions no longer count for rehabilitation purposes (except in some professions as alluded to previously) for longer periods. Insurers are no different from other institutions such as employers, in considering whether there are any unspent convictions when deciding how to conduct their business.

    You were convicted of an offence of speeding. You received a fine. That is spent after 5 years. The insurer is interested in your record of convictions. Hence the question.
