Car Insurance: clean license, but still stung on SP30... WHY???

But in the eyes of the law, the offence is now gone. It happened, but has now gone, and the points are expired/removed.
So to insist I tell them, then be stung still, during a clean license, is inappropriate.
Despite everyone patiently pointing out to you that the offence is not now "gone", you still stick to the (false) premise that it has ("gone"). (It is actually "the eyes of the law" that states it doesn't "go" till 5 years are up)
Time to give up on this one!0 -
Of course your friends will agree with you. They're your friends.
You are mixing two separate concepts in order to try to justify your argument.
The law states two separate things:
1. points no longer count for disqualification purposes after 3 years, and can therefore be removed from the licence after 4 years. This is the only relevance of points - i.e. whether you can be disqualified under the totting up provisions.
2. convictions no longer count for rehabilitation purposes (except in some professions as alluded to previously) for longer periods. Insurers are no different from other institutions such as employers, in considering whether there are any unspent convictions when deciding how to conduct their business.
You were convicted of an offence of speeding. You received a fine. That is spent after 5 years. The insurer is interested in your record of convictions. Hence the question.
Where is the proof of the offence?
As far as I know, it is with the police, tho not a "criminal record", and it is within the SP30.
The SP30 has expired.
So I want to know where the 5 year thing is recorded? If I rang my Police station, would they confirm that my offence "remains" for 5 years?
When you get caught speeding, you know you get the points etc....
And if you do a bit of reading, you see it lasts about 3-4 years. What you do see, is what you are eluding to, and it comes across as slightly con-like for the insurers to make use of it. You sound like you know what you are talking about, however, even my neighbour went through the same thing, and was also appauled that even after it has expired, you still get stung.
My friends are only telling me what happened with them.0 -
My license is CLEAN.
It should not be stung after it becomes clean. Simple!
your licence is clean
you history proves you are an elevated risk till the insurer
the insurer has deemed 5 years of keeping your nose clean is sufficient proof
think about it. the postcode loading is far more unfair.
your policy increase is through your own actions0 -
Having spoken with a Police Officer face to face, and on the telephone, I can now confirm categorically that there is NO 5 year issue on an SP30 for speeding.
If the DVLA state the offence to now have expired, it has expired in the eyes of them and of the Law.
The 5 year thing for insurers is just their way of checking your history. I will be asking them about this, as I know some offences will have longer terms, driving without due care, hit and run etc. But an SP30 does NOT go over 4 years.
So it maybe that when you select YES to 5 years, and then select SP30 from the list, the date from which you had it, then becomes void for the insurance.
But I will ask. All I have read here about 5 year, Rehabilitation etc, is all poppy !!!! - confirmed by DVLA and my local Police.0 -

Points count for totting for three years. They are removed from a licence after four years and if your insurer asks for convictions over five years, you're bound by the principle of utmost good faith to declare them. This is because under the Rehabilitation of Offenders Act, anything which carries a fine become "spent" after five years, so the insurer is entitled to ask and to use the information to price cover accordingly until then.
What's the premium difference? In my experience, a single SP30, especially one over four years old shouldn't make that much difference.
It should made make no difference whatsoever. And as a policy holder, it feels inappropriate to even enter that I had one.
When looking at the screens of the insurance companies, you do see all the other options of offences. However as a person who now has a CLEAN license, it does feel odd to enter it.
I will ask what the difference is with that SP30 declared.
"Good faith".
According to the DVLA, if they are asked by anyone now, if I have had a SP30 in the last 5 years, all they will ever say, is "he has no speeding fine SP30 on his license".
They won't comment beyond the 4 years. So in theory, you could just say "NO" ot the insurance company!
The Rehab thing is irrelevant here, as I have seen in this thread.
Yes, dog with a bone is spot on!0 -
I had my car broken into and I had to declare this for five years. Nothing stolen just a window replacement on the insurance.
Just one of the stipulations of the insurance companies - knowing about your driving history and claims you have made in the last five years.
I wondered if you were caught speeding and given the choice between points and fine or going on a speed awareness course would you need to declare this?£2 Coins Savings Club 2012 is £4.............................NCFC member No: 00005.........
