Always entertaining and thanks for your (sort of) support (quoted by me slightly out of context) I admit my error and missed that amidst all of the verbal sparring and jousting.
As another snippet, they have actually contravened their own T&Cs in how they acted which they confirmed in their defence paperwork. :T

I don't understand why a small claims has been made against Pay Pal?
To me it just sounds like the OP will hope Pay Pal will pay out instead of dragging it through the small claims courts.
Pay Pal met their side of the agreement by completing the transaction and offering a resolution process
Surely the small claim should be against the Seller, who didn't complete their part of the transaction.
Hope you get it sorted either way.
Going forward remember to fund your Pay Pal with your credit card so you can then involve them if the transaction wasn't completed to your satisfaction

It is slightly different to your case but I was pursued by ebay's collections team for fees that I refused to pay. (won't go into detail but the resolution service was a farce and my rights as a private seller were meaningless). I refused to pay on principal as I was already out of pocket on postage for approx £50, to pay their fees of £50+ for NOT selling my item was just an insult. Anyhow, eventually it got to their legal people and I got the usual nasty letter threatening Court action. I rang them up and explained how my rights under English law had been abused and I also pointed out that I was very happy to go to Court as I believed I would win. They asked me to put everything in writing, I said I would but as there had been a lot of correspondance from the buyer and me and to ebay (no response from ebay) plus a great deal of evidence for my case that would need putting together, I would have to charge them for my time. I think I suggested a fee of £200 to them. Anyway, long and short of it was they dropped everything and I have never heard from them again. Moral of the story, you can stand up to these people, it is always worth it if you feel strongly about something. (actually I was quite looking forward to going to Court but never mind, you can't have everything)There are three types of people in this world. Those who can count and those who can't.0

Good on you and yes of course anyone can stand up to any company regardless of their size. I think many people don't bother as they think they have no chance but in reality Pay Pal are a business at the end of the day, without customers they are nothing. Although the perception maybe that they are so big that they don't care if you use them again or not, they in fact do want every customer they can get now more than ever.0 -
Well after a long break for Xmas and upon him (or her) reading the court file, the Judge has not thrown the case out at first hearing so there is some merit to it after all.
Had I been claiming without cause it would all be over but there is still cause to be optimistic.0 -
Just when you all thought this had gone away - there is news!!!
The district judge has considered the case and has said there is a case to answer so I have been given a court date - AWESOME.
Had it been a lame duck, he would have kicked it out (as I said before).
So I get to see Paypal's lawyers in court - I cannot wait.
So my primary aim has been achieved - they are in court, secondary is to win. Let's see how we do...............................0 -

I care not a jot about T&Cs but there is no way I am sharing all of the facts here.
You have a small snippet of information that I gave you yet you argue with certainty. I would never be so forceful in my assumptions without any depth of knowledge.

If you want to prove your court hearing, then go ahead and do so.....it you dont, then thats your choice too. Either way, Im not that interested in yourl hot air and nonsense.
