    I think you've been drinking to much. To have even the most minute chance of winning (which you won't) you would have to show paypals terms and conditions and their timelines are unreasonable. I cannot see any way you'd convince a judge of that also they are not breaking any consumer law.

    It comes down to your mistake in the end you didn't spend 2 minutes checking the timelines and making sure you put your claim in on time. Now you're just trying to blame paypal for your mistake. Be a grown up admit you !!!!ed up and move on.

    It is generally accepted that eBay / PayPal protection generally favours the buyer... you were the buyer here, and missed the deadline date (which was quite long)... good luck, I think you'll need it.

    I would emphasise that the sums involved are fairly substantial: a fee for them to decide that it belongs on the small claims "track", and then a thumping 350 pounds for them to book a hearing.
    Not to mention any Paypal legal costs if you lose.

    Contact the Ombudsman - it's free...
    I am also currently in dispute with Paypal over something and the Ombudsman are on the case!

    can you advise on this please? I am almost £500 out of pocket after paypal closed my account, they reversed the payment I'd made to my bank and then closed it due to' suspicious activity' :mad:which related to selling but not through ebay, they have since closed my ebay account since it was linked :mad:
    Paypal do not acknowledge emails/ letters and I am out of pocket :mad:

    1. Did you actually PHONE paypal and ask the to re-open it as you'd been away? If not, do it!

    2. Did you send Paypal a "Letter Before action" before starting the court process? If not, you have wasted £25.

    3. Do you have tracking showing the item has been delivered? If not, you won't win the court case, so have wasted £25.

    Would've = Would HAVE (not 'of')

    No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

    Yes, yes and yes.

    I don't care about the £25 (slight blasphemy on this website!!).

    To those who asked about accessing the internet whilst on "holiday", I go to places where the internet is not even invented yet and fight people called the Taliban. Not exactly my idea of a holiday.

    I just want those &*%$tards at Paypal to feel £25 worth of heat as they love to dish out.

    Also, small claims cannot leave legal costs to any party (winning or losing).

    Back to the Boxing Day champagne and goose pie.

    Oh yes they can.
    Generally they don't, but that's not the same as saying that they can't.
    If you read the Gov't website on the small claims procedure, they make this clear.

    In most cases, the court will not order solicitors’ costs to be paid by the losing party in a small claims case, and if you instruct a solicitor you will have to pay the costs yourself

    Can I just wish you all the best. Paypal refunded nearly £600 of my money, to buyers who had actually received the items. It only happened recently and a couple of the buyers have done the honest thing and refunded.

    Paypal don't give a t*ss and I too have just done a letter the the Financial Services Ombudsman and their Chief Executive.

    Might take it down the small claims route, but as they are not UK based this may be futile. But for sure I'll be suing the buyers - if they don't do the right thing. As for Paypal I will be causing them a lot of trouble I promise you that.
