    Totally understand but I am not going to give details here of my case.

    I do not want them to roll over, I want them busy!!

    As I said before, it is not all about winning although I am more confident than I was before; let's just keep it at that for the moment.

    Pals T&C's are in addition to your rights as a consumer, not instead of.

    You dont have any chance with Paypal whatsoever as they have not done anything wrong. Your issue is with the seller. You ought to be sueing them (if they are in the wrong), not Paypal.

    I feel you are blowing hot air because you messed up yourself and are looking for someone to blame. You came here looking for confirmation of that and havent got it, yet you somehow seem to miss all the posts that say "Paypal have done nothing wrong".
    Maybe your problem is more to do with reading and understanding?

    I get your point but there is more to this though I am not giving the details in public.

    Trust me, I am not blowing hot air as Paypal are in the wrong.

    I do appreciate the relatively blind speculation but that is all people can do who only have part of the full picture. That is my fault as I have not given all of the facts.

    Check my original post at the start of the thread - it is just about my day against Paypal. The result is not the key element.

    An excellent defence as that means now you are taking on the might of paypal and their entire T and Cs.

    Many have wanted to take on paypal and have lacked the millions to do so, by forcing you to take them on in their entirety is a very clever move on their behalf.

    No, I don't understand it at all!! You made a mistake, deal with it and move on. Just all seems like a waste of time to me. You might have one or two Paypal drones kept busy for a few hours but that will have no noticeable impact on Paypal whatsoever and it won't hurt them in any way at all. Even if you win they won't even notice it in the grand scheme of things and it won't set any precedence. Its all just a bit futile really.

    Having said that, each to their own and if you have nothing better to do with your time and you find it entertaining then the best of luck to you.

  • Good luck to you. I can't understand people who feel the need to tell you not to bother because it won't have a huge impact on paypal.

    As most sensible people on here understand, that isn't the point. If everyone does nothing then nothing ever changes. If Noone ever stood up for what is right the world would be a very terrible place.

    But the whole point is that Paypal actually went way above what is expected of them by law with their T&Cs in this particular case and it was in fact the OPs fault that they missed a deadline. What exactly do you expect to change in this instance if the OP wins? If the OP wins or loses, it changes nothing in the whole scheme of things!

    The only potential result that makes this worthwhile is for the T&C's to be changed. Noone is saying this will happen if this guy wins but it is one step towards it.

    Of course as most eBay users seem to roll over and take their crap and go back again like lapdogs, this could take some time.

    So they already offer way more than is required but because of an individuals mistake, that isn't good enough and you think they should change to offer even more?!? Jeez - there's no pleasing some people!!

    This sounds as if you have a grudge against Paypal? Over this matter or over something else?

    To be fair to the OP they have lost £150 and they are right to be upset problem is it isn't Paypal's fault, the guilty party in all this is the seller for not refunding for a returned item. Any anger should be directed at the seller.
