Strictly to be on MIR you have to have multiple barriers to work (i.e. more than one) and have a need for ongoing intensive help to find work. However whether you've had some work experience in the past few months is the bigger decider.
When they do the returner interview the adviser should have asked you many questions to establish which scheme to put you on and that's all entered into the Customer Assessment Tool (CAT) - which by the way they are supposed to inform you they're using before they do use it and which you can refuse consent - from which you get 'scored' and which is supposed to be how they decide MIR or JCPO.
In practise the default option is MIR unless they have limited resources and then you may be lucky and get assigned to JCPO instead.0 -

I'm not even on JSA any more and I'm being harassed by the work programme.. I ended my claim the day after I was referred (never met them, never signed anything) and even told them on the phone, and sent them a letter (which they phoned to say they had received).. and I'm STILL being harassed!0

How would we know what they have said? Mine refuse to let me see it and say they do not have to. I have asked the JC to request a copy for me so I can see their lies!
The exit report is supposed to form the basis for the returner interview but as many providers have not supplied one and the ones that are supplied have no information beyond a statement that the jobseeker is "job ready" most are next to useless.
So don't expect too much when you receive yours!
From what you have described thus far it does not sound like you have had the "real" initial returner interview. How long did it last?0 -

Under the new regime:- Higher level sanctions (for example for leaving a job voluntarily) will lead to claimants losing all of their JSA for a fixed period of 13 weeks for a first failure, 26 weeks for a second failure and 156 weeks for a third and subsequent failure (within a 52 week period of their last failure).
- Intermediate level sanctions of four weeks for a first failure, rising to 13 weeks for a second or subsequent failures (within a 52 week period of their last failure) may be applied following a period of disallowance for not actively seeking employment or not being available for work.
- Lower level sanctions (for example for failing to attend an adviser interview) will lead to claimants losing all of their JSA for a fixed period of four weeks for the first failure, followed by 13 weeks for subsequent failures (within a 52 week period of their last failure)
