    i think they say that just to make people think stuff it i might as well let them have access now. unless they can change the law that makes it illegal they wont be legally able to force access.

    Your advisor clearly doesn't have a clue, which could be good or bad for you.

    how do you sign on daily if you are working all day on a placement somewhere?


    yeah sorry i meant the thing you do after the wp, sighning on daily, are you still entitiled to holiday during that?, she said to me id have to sighn daily for 6 weeks, im nearly at the end of that, im dreading what comes next then

    Today i just had the Doubt Letter to fill in and sign. Filled it in with the info and sent it off. Went to the beach with the kids and got home and found FOI had emailed me regarding what i asked about MWA Guidance.

    I asked for current Guidance which they currently use and this is the link they sent me

    They said
    The relevant part is Regulation 3, ‘Selection for participation in the Scheme’, in The Jobseeker’s Allowance (Mandatory Work Activity Scheme) Regulations 2011.

    Here's what that says
    Selection for participation in the Scheme

    3.—(1) The Secretary of State may select a claimant who is aged at least 18 for participation in the Scheme.

    (2) Only a claimant who is required to meet the jobseeking conditions(1) may be required to participate in the Scheme.
    No where does it say
    In section 18 of this document it states, "Given the policy intent of MWA, the following claimants must
    not be considered for referral to MWA: taking part in or recently completed* another employment
    measure (contracted or non-contracted) aimed at helping them move closer to the labour market"

    I'm not sure I understand what's being said. This is where you will find point 18 of The Mandatory Work Activity procedural guidance (which may now be point 19 in newer versions): https://www.whatdotheyknow.com/request/122754/response/298962/attach/html/3/MWA%20guidance%2023.07.12.pdf.html.
    That clearly states that anyone recently involved in an "employment measure" MUST NOT be referred to MWA.

    And section 3 of SI 2013/276 [JOBSEEKER’S ALLOWANCE (SCHEMES FOR ASSISTING PERSONS TO OBTAIN EMPLOYMENT) REGULATIONS 2013] http://www.dwp.gov.uk/docs/a11-6101.pdf , which is headed: Schemes for Assisting Persons to Obtain Employment (in other words it is an employment measure, as stated in the original FOI) has, as point (8) - The Work Programme.

    So the Work Programme is an "employment measure" and therefore if you've just come off it you CANNOT be mandated to MWA.

    i dont know. if it was booked beforehand i dont see why you wouldnt be able to go. they may not like it as they clearly make people sign daily to annoy them. if you were away on the signing day that releases your payment then your payment wouldnt be released until you reported back. as far as the daily signing goes that you would miss while away well its tough on them, you will miss them or they will add them on to the end.
    if you do the following you should be ok.
    1. inform your adviser.
    2. show proof you already had it booked.
    3. fill in going away form properly and hand it in before you go away.
    4. report back on the first week day after your holiday.
    5. return back to whatever signing on schedule you have.

    Well had appointment today. Got referred back to MWA like a boss... They changed policy now :S

    They said they had regulation checked and it's correct. They said to me this morning that it's been changed for the
    The recorded information we hold that best answers this question is Regulation 3(8) of the
    Jobseeker’s Allowance (Schemes for Assisting Persons to Obtain Employment) Regulations
    2013,
    So now The Work Programme is the same but it's not an "Employment Measure"

    How the F they work that out i will never know. Is there any way i can get some more info on it before i have my MWA appointment on Tuesday?
    I don't want to be dumped on MWA again when i'm not supposed to be on it.

    Wish i could afford to sign off cos JCP is PITA.
