The judge will tell you on the first point, thats the risk you take on the second.

Thus there is not a written rule which decides and is quite abstract / unwritten?
  • Press the reset button and play again.
  • With the evidence you've presented so far, I can't see how a judge would possibly not find in your favour.

You would have to ensure the judge knew all about:
    1) Their racism towards your car and numberplate and their weaseliness towards you.
    2) You had to chase the causer with your hazard lights on at over the speed limit to catch him because he was speeding.
    3) That the window fitter's expert opinion "When a car window gets smashed, there is [small] percentage where the mechanism is also broken"

You could also probably claim additional costs for the inconvenience of having to open your door.

    Best of luck.

So its ok to speed with hazards on while your writing and on the phone?

    I must remember that one.

This account is only yours and not factual, I cannot verify the speed. The road leads to traffic lights / traffic slows and perhaps this made the causer stop also. I would have memorised the car registration number. I phoned the emergency 999 call number when I had stopped the car.

Your point 2 bothers me, see my other post.

    Real life.
  • so. this racism lark.

assuming you could possibly be described as "black", with a black car and obviously the registration plate "B1 ACK" (seeing as you mention the plate has something to do with your totally obvious victimisation), who or what is the racist here?

is it the driver of the car in front? "oh no, there's a black guy in a car behind me, i'm gonna chip that n-word's windscreen"?

    no?

the car in front? "goddamnit, there's a black car behind me, bloody colour shouldn't be allowed, i'm gonna use my tyres to flick some stones at him"

    also no?

the stones themselves? "woo, we're airborne! hey look, a black guy! let's aim for his windows"

have i got it wrong and you're chinese were driving a red car with a yellow sickle decal and the registration plate H3 RRO?

seriously. brown stuff happens. fix the damn window. move on with your life.

I'm sorry. Just disregard that part then. So long as the rest makes sense, you'll be laughing.

The judge always takes the side of a claimant in a small claim case.

For instance: When I went to Turkey on holiday I didn't like cheese omelettes and the hotel had cheese omelettes every lunchtime.
I complained to the holiday rep and she said that I could always eat something else.
I said "that's not the point. I don't want to not have to eat cheese omelettes. I want to not have to not have to have cheese omelettes." Would they see my point of view? No!

So I sued them for the full cost of the holiday. There's a story in there somewhere, right?

The laws of physics state if the causer is speeding and you catch him up, you must be speeding too. Make sure the judge don't think you're the causer. It's easy to get confused.
