Car Window Smashed by Off-Road Driving

So, an oncoming vehicle flicked up a stone which broke your window and you:
1) Got their registration plate
2) Obtained their details
3) Contacted them and their insurer
4) Knew that they were going at 76 Mph
5) rather than grab a winding mechanism (how was this damaged by the glass breaking by the way?) And glass ,have spent 6 months going through all this

Well, I'm spent.
The causer pretended and kept driving away. I put on my hazard lights and went after the car to note registration number and to indicate to them that they stop. The window mechanism is cheaply available on ebay though it is not an original part and thus their insurer is not going to pay for it, at least that is what the glass fitter said. When a car window gets smashed, there is percentage where the mechanism is also broken.0 -

The incident continues after the car window is broken because the broken glass was blowing in and into the eyes and to stop injury without using hands and in those dangerous circumstances, I had to use slightly the switch mechanism.
I also wanted to check slightly if the mechanism was okay. I thought as the motor in the mechanism was making the usual sound, that it was functioning.
The glass fitter also said to me, 'When a car window gets smashed, there is [small] percentage where the mechanism is also broken.'
The mechanism is inside the door and invisible, thus it is quite difficult to know when the mechanism got broken.
I know that the car window was okay before the incident and these things only happened as a domino.0 -

If I sue their insurer in the small claims court, is my case justified on it's merits? Their insurer has threatened ordering their legal costs to be paid if I loose the case.
The judge will tell you on the first point, thats the risk you take on the second.0 -
