My case if it goes to small claims court is about Corporate Racism (weasel style) from their insurer.0

Just be grateful that you're alive and didn't end up in a much more serious accident.
For the cost of your glass, is claiming worth while when you consider you may possibly have to pay the excess and your premiums will probably increase for the next 5 years?
Seriously, I know your pride is hurt and blah blah blah, but be grateful and move on. Don't cut your nose of to spite your face.
What's to stop the other driver saying he to swerve to avoid you as you were wandering all over the road and appeared to be using your phone? Perhaps he could suggest you were driving like you were intoxicated and insist that your insurance, MOT and licence were all verified.
You could try the County Court, but I suspect the district recorder or judge would say to you "Sort it out with your car insurance company, that's what they are for"
Personally I don't believe a word of what you say, so good luck with your insurers if you do go that route because they are a tougher audience than me. I always find it particularly loathsome when someone introduces the 'race' card as a distraction - get rid of the chip on your shoulder and learn to driver properly!0 -
