    I still think this needs to be made clear,These claims of I had x amount back are not really true if the agency has received the money.

    As angelwillow says, it is mentioned quite a few times on the board about what will happen if you're in DMP or similar. This thread in particular has discussion for those in this situation:

    To be quite honest I could have found something better to do with the £27.00 rather than help an agency get their money back quicker,and me suffer all the stress helping them.

    I know it's frustrating, and it's your choice at the end of they day, but surely reducing your debt is better than nothing.

    Thankyou for the link.

    People are still confused and I believe mostly unaware of where the payment is going to go.If possible, the powers that be could make this a little bit more clearer,even a "sticky" with the details on the card reclaiming page would help any confusion and go a long way.

  • I can sympathise with you and understand where you are coming from - honest! I have had some 'hard fought for' money go straight back to my credit card without ever 'seeing' it aswell.

    Hello everyone!

    I have a closed Business account with Barclays
    It is approx £1630 overdrawn but i have calculated that approx £1700 is charges.

    I have only had the account 18months!!

    The problem i have now is Barclays have passed on the debt to a bailiff company and they are hounding me for the money.
    I cant pay them and i cant seem to hold them off till the test case.
    I have explained to them that if Barclays lose the test case we are pretty even but they are not interested.

    Any ideas?

  • Ask them for proof, then tell them not to contact you until after the test case. If they fail to stay away contact the police because they are harring(sp?) you and that is against the law.

  • Hi, my credit cards were being dealt with by a debt agency. They were chasing me for 274.00 for one of them. My claim for charges was over 1000.00. I CCAd the Debt collection agency and did the sar to CAP1. I eventually went down the MCOL route and got my credit card charges back less what i really did owe them, So i still got 800 in my bank account. You will get your money back less what you them. If the total debt was for 1000.00 and your your charges were 200 then your refund would be used to reduce the debt under normal circumstances. If you owe them more than they owe you then the DCA may well take the money. Please do not be put off claiming

    Unfortunately mine will not.There are 2 accounts which are closed and old.I recorded a conversation with a debt agency querying what happens if a debt got sold on.The answer was that sold accounts were totally in their control,if it had been passed on for collection then it could be accessed to refund the difference.

    I can here my voice ok but no voice of the agent.Bit of a !!!!!! really.

    I have asked for the paperwork relating to the debts and await their reply.

    I'm sure this will not be long as their payments are on hold.
  • Please pleaeeeeeeeeeeeeese do not believe a word they say, Were you reclaiming cgarges that were in the last six years hun, Never talk to a DCA on the phone. Golden rule. I have heard them say some stuff but i really dont think its right. Who were you claiming from and for how much. And what were you claiming. For a start were these DCAs legally have a right collect this money Were they assigned the debt or were they acting on behalf of the original creditor. In my eues on here we never give on anything uless its a dead cert we wont win. Sorry not read the whole thread. Only the last page. Any info if you will would be great. It not over till its over. Whwho are the DCAs. Hamtons, lowells, BCW, Brian carter to name but a few i have dealt with myself. If there is a way round it all we find. Even i have to go down the bloody yellow brick road x
