Anyone had experience of a company/solicitor doing the work of reclaiming? (merged)

Hi all
As I am sure you can see this is my first posting. I have been called several times by Total Refund. I have asked for references or testimonials from satisfied customers, but they can't give me any despite assisting over 17,000 (TR figures) people claim back their bank charges. They are registered on the gov. web site, but does that make them legitimate? How do they do it for £49.99, when the cost of time & calls to me alone must be a fair few quid? & finally does anyone know of one of the 17,000?

Write to them and state that you are cancelling your contract with them due to a "complete failure of consideration" in respect of your account. (use those exact words, they will mean something to a solicitor) ie they have not done what they agreed to do for you contractually. Be prepared to fight them, I have just served notice on them as they still have not sent me my due settlement for the ONE out of FIVE claims I passed to them. Whatever happens DO NOT PAY THEM A PENNY, when you cancel they will intimidate you and try to charge you £150 + vat cancellation fee. They will pass your "debt" to MIL collections (and add another £50), do not give in. Make yourself as big a pain in the !!!! as possibe. Ask MIL for proof that Bank-Smart have passed the "debt" to them and emphasise that you are in dispute with Bank-Smart as to the validity of their charges. Like the banks, they will back down before the court stage. Even if they do take you to court, what defence do they have for doing nothing for 11 months? They are untrustworthy, unprofessional and faceless (do you have a name of an employee???). If they try to use the defence that they have kept you up to date via your "client login page" and they can see through audits that you have been logging in regularly, I can tell you that by simply looking for your logon ID in the URL and changing it (for example say yours is 1999, change it to 2000) gives you access to any other clients claim details!, and therefore cannot be relied upon as evidence.
Please don't hesitate to contact me if you need any help taking on this lot, they are low life and have no place in society.0 -
A flyer was sent out from the above company that offered 'services'
1. £25 for a DIY pack, basically letter templates...probably stolen from here
2. A 'No win, no fee' service that takes £10 'fee' and then wants 25% or £250 to 'handle your claim.
The company benind it is Piccadilly Finance. Yet another example of these debt companies swindling those who can least afford it.

I have been contacted today, by a company claiming they can guarantee if you pay them fifty nine pounds, they will get your bank charges back within 20 weeks. I thought they were on hold? Do you think this is a scam? He told me they were called 'total refunds, something or other' I havn't done anything since they declared court proceedings. Should I be doing something? Can this company get my money back? thanks0

I have used a company called xfp solutions i am starting to get worried as I seny them my statement over 6 month ago and I have,nt received confirmation that they received them. I have also been trying to phone them but there number is unavailable. Anybody know anything about them.0

There is plenty of easy to read information available, on a step by step basis, with template letters which allows anyone to claim themselves.
The information is available here or other bank claiming sites eg Consumer Action Group.
Honestly, its a simple process, so why pay someone, to do it for you. Get your claims into the banks now and start claiming your money back. Then await the first decision on OFT Test Case. If you don't submit the claim just now, you stand to lose on post 6 year claims due to limitations.
Remember, a lot of these claim companies have probably taken their information base from dedicated claim forums, who are self help and don't charge you.Please ignore those people who post on this forum who deliberately try to misinform you. Don't be bullied by them, don't be blamed by them. You know who I mean.

ust browsing site earlier today and needed to know this, please HELP! I have a DMP and want to reclaim cc's back, due to time I thought I would pass all info onto an agent who, if I won, they would reclaim 30p back in the pound, which I thought fair enough its alot of work involved. Now, I realise if I won, the payment would only reduce the balance owing and I would have to pay the agency their cut!! is it too late to back out?? or should I carry on?0

You need to check the small print in what you agreed to with this company and see if you can cancel any contract you have made with them.
Then you can start your reclaim yourself as obviously any monies that help to reduce your debt will certainly be worth it.0 -
.....the other night about bank charges.they explained that they would fight our case for us but for a small fee.i explained that myself and my husband would be doing it ourselves.Cannot remember the name but they have since phoned us 4 more times.my number is ex-directory so unsure how they have came by it.Thought i would let folk know incase someone had the same trouble.0

Dear Collegues,
I saw the advertisement of 'Financial Claim UK' for 'Refund Charges' on Money Saving Expert.com about 1 year ago. I asked FCUK to deal with my banks and credit card files in April 2007 and I sent them about 48 claims (1 third for banks and 2 third for credit cards).
From that time, I am phoning them every week, once a week to know at which state my files are. I even know the name of two people in this FCUK firm that I am contacting every single week for near one year and I am hearing all the time the same answer:
We have your files but we cannot discuss your claim over the phone but a manager will phone you and will write to you within one week! Till today I never received any reply from them, not even one letter!!
