I've been thinking about taking this course of action. If it was a commercial debt and I was being treated like this by a debtor I would take this action so I can so no reason why not to in this instance. There is a debt clearly owed which has been admitted by Lloyds in their offer letter so there is no abuse of process and they have no defence to it. You have to be fully prepared though to follow it up with a WU Petition which will cost if you use a lawyer but you can claim this cost back.

A Stat Demand is a very effectiive debt collection tool if there is no dispute of the debt and yes HMRC use them alot.

I am not sure that this would constitute a debt for the purposes of a statutory demand, but I am not an expert in this field.

What I am considering is potential legal action for breach of contract. Despite them upholding my complaint back in August they have still taken four lots of PPI premiums since then. This has to be a breach of contract, and they are obliged to put things right and pay me damages in my view.

The bonus of doing things this way is that I would not be suing them for the mis-selling (I would leave that within their remit). It is the consequential effects of not restructuring my loan that I would be suing for, which is different.

well, just emailed my MP asking for help. I copied in * and * but their email addresses are blocked - so resent the email to my MP stating that and copied in the default ppi complaints address. Not wanting anything special - just to be repaid the money that I am owed. As of now I have £27 to my name until 18th December - I'm a student Nurse and with that £27 I have to drive to and from hospital (about £60 per week in petrol ) etc.. In the mean time Lloyds will give me a penalty charge for going through my overdraft limit when my mobile phone direct debit hits. Have asked for an extension to my student overdraft in light of the ppi money maybe arriving one day but Lloyds said no. So depressed :(

great news for you but what also confuses and really really really irritates me is how come some people are recieving responses and promises, albiet alot of the time they are false promises but still you have a response.....i have not had a response from him as many many others have not....continuity is obvsiously not their thing!
