  • Thanks again Mart...CCCS have given me a free phone number I must get Ned here to mine to speak to them first and then he can give his consent for me to be like his 'advocate' I think you'd call it...so then they can give me instructions in order to help him. So that's good,i have told mediation to give me a little time as I need to get a reply from AW concerning the amount and a breakdown, and the matter of the confusion re: court costs payable or not payable by him? and I have downloaded the form to claim it (fee remission so that we are prepared if need be,) from your link many thanks, thanks once again will keep you posted...

    I mentioned to mediation that neither form had a court stamp on it and she said so therefore it hadn't come from court but AW....then she did say she believes AW will be prepared to go to a final hearing if need be...

    I mentioned to mediation that neither form had a court stamp on it and she said so therefore it hadn't come from court but AW....then she did say she believes AW will be prepared to go to a final hearing if need be..I think it was unnecessary for her to say that - the mediator is supposed to be completely unbiased - A final hearing (or any hearing at all), is clearly not needed as Ned is, and has been paying, although a little late. .

    Seems things are a little further along.

  • I've always been an RC person where previously state owned companies are concerned and my understanding of the law is that the water authorities are not allowed to deprive people of a water supply no matter what (not like gas and electric). So Ned should just tell the water board to stuff it. Worse they can do is go for the debt in court which presumably he can't pay (so what?). Can't see the court taking 50p a month off him. CCJs are only a concern if you're going for credit. Did work for Experian for about 14 years.

    Did you not read the thread ? They ARE taking him to court, that is the whole point.

    I did thanks, I did reply, but am not sure he wants to give that poster his case number details as yet,

    latest is, that AW have admitted in writing that the documents they sent (designed to fool the recipient into thinking they were official court documents) were infact generated by AW, and they have adjusted the amount he owes and have begrudginly acknowledged since the court involvement that there has been 4 or 5 regular installments, (although they never stopped being paid anyhow) they have printed a little table of payments received, (some have been 2 in one month as late for reasons already known) I would need to go through these at length, to check they are accurate, the mediation is next and has to get an appointment as they say they are absolutely full for the time being, (many other people in same boat?) but gave a later date from when they are available and that court has 'stayed' it....I will advise Ned to get that in writing or else the AW will deny it, and annul their 'arrangement' I don't trust them.

    When you say, "they have adjusted the amount he owes", do you mean that they added amounts to the original amount owed, or do you mean, the amounts they added previously, have now been taken off again? In other words, do you and Ned agree with their figures?

    Let's wait for the mediation.

  • Mediation will be thursday next, the amount has changed from what they originally claimed, they are still insisting he pays their court and solicitor costs, and they have taken off payents which have been continuing to be paid off (his monthly installments) I don't have the figures to hand, but I think it should be less, however as after the six month period elapses and he has continued paying installments, the remainder is to be paid by AW trust, so perhaps just let them get on with it? Oh hang on, no, though I think that they asked Ned to pay them for their cost with a cheque he - doesn't have one (as they well know) and think it has to be a separate payment they insist he has to make, not sure what to do regarding that....

    He was told to expect that the mediation will last at least one hour, what on earth makes it last that long? what will there be to talk about? to take up one hour.?

    As far as I can see it will be "do you Ned agree that you will pay installments to AW, " "yes I will continue to do so having never missed any" "ok then that's settled" cue the music to tom and jerry......
